Prime Farmland Irrigated Cropland. See, Attachment 2 (letter to the Morgan <br />family stating that their lands will be reclaimed as Prime Farmland Irrigated <br />Cropland). No higher level of-protection of the farmer is available or possible. <br />Ms. Turner does not have standing to address reclamation requirements <br />applicable to lands other than the Morgan Property. WFC also incorporates by <br />reference its response to Comment No. 6, above. <br />Comment No. 9: <br />Page 2.04.3-7 "in most cases pre-mine irrigation methods utilized flooding <br />the land using gravity" Side rolls which are more efficient." None of this is <br />true. Sideroll irrigation also uses Gravity? DAH! Mr. Morgan has not flood <br />irrigated this place for 39 years. Most of us used gated pipe, big guns or <br />furrows. All of these were and still are very efficient ways of irrigating. <br />Weimer Ranches has over 30,000 acres and one of the largest landowners in <br />this country and they do not own a side roll! They are one of the largest <br />producers of hay and corn other than us. Corn, Sunflowers, and other crops <br />cannot be raised under a side roll system and Ross Gubka has documented <br />many times now that 50 shares of water which Mr. Morgan used historically <br />for 50 years to irrigate what they are mining can not be done with a sideroll <br />system, We had siderolls is, big guns center pivots, gated pipe, and furrows <br />long before the mine even is what they were. <br />"Irrigated farmland is meant to encompass irrigated pasture, cropland, and <br />hayland and are differentiated by the amount of alfalfa in the fields as well as <br />the intensity of management." What a stupid statement. Cropland is <br />anything that is HARVESTED oats, grasses, legumes, trees and it has <br />NOTHING to do with the intensity of management or the amount of alfalfa.. <br />Where do these people come from? Hay land can be straight grass, straight <br />oats, straight corn stalks, or combination of any but not limited to those. <br />And even pasture can be cropped and harvested and all require a <br />tremendous amount of work, management, fertilizer. Again, ALL lies. A lot <br />of crop land has NO alfalfa. Anything that is harvested, even trees, are <br />cropland. Hayland can be any type of hay, grass, Kochias, these are types of <br />hay land. I feel our chain is just jerked here. Correcting all of their <br />terminology and false documentation does not change the fact that they <br />should pay for all of these violations of State and Federal laws. PR 6 is illegal <br />when false documentation makes up 90% of it. <br />WFC Response: <br />The reclamation plan for the Morgan Property contemplates that the Morgans <br />themselves will irrigate their lands in the way they see fit, and WFC has reached <br />agreement with the Morgan family concerning the type and extent of irrigation. <br />See, Attachment 3 hereto (letter agreement concerning acreage and irrigation of <br />the Morgan Property).
