WFC Responses to Morgan Property Issues <br />As directed by DRMS, WFC provides the following documentation regarding <br />issues raised by JoEllen Turner on behalf of the Morgan family. For purposes of <br />this response (and the detailed responses to comments contained in Attachment <br />1 hereto) WFC will refer to the property owned by the Morgan family as the <br />"Morgan Property." A detailed legal description of the Morgan Property is <br />available should the particulars of such description be relevant in any respect. <br />The DRMS requirement as communicated to WFC is set forth below, followed by <br />WFC's response. <br />DRMS Requirement: <br />"WFC must address and resolve the issues presented by the Morgan Property <br />landowner representative (Ms. Turner) in the objection letters received by the <br />DRMS on June 7, 2010 dated June 4, 2010, and separately transmitted to WFC <br />on June 18, 2010. Landowner coordination and consent is required by <br />regulations and statute. Such coordination also seems to be a point of previous <br />agreement between WFC and the Morgan's as evidenced by the lease provision <br />submitted with the June 7, 2010 objection letter from Ms. Turner." <br />WFC Response: <br />WFC has initiated or completed the following activities relevant to this <br />requirement and has reached or is close to reaching agreement with the Morgan <br />family regarding the following: <br />WFC agreed in 2008 with TR57 to treat the remaining topsoil on the <br />Morgan Property as two lift potential prime farmland soil and subsequently <br />agreed that the entire Morgan property is Prime Farmland. See, letter <br />from Ross Gubka to Mr. and Mrs. Frank Morgan, Mike Morgan, and <br />JoEllen Turner dated May 24, 2010, attached hereto as Attachment 2. <br />Through both TR57 and PR 05, WFC has implemented Prime Farmland <br />requirements on the Morgan Property since 2008, even though these <br />permit actions were not formally approved until 2009. <br />2. WFC has agreed to plant the Morgan's preferred variety of alfalfa on the <br />Morgan Property. See, Attachment 2. <br />3. WFC has agreed to irrigate the entire Morgan Property, as requested, <br />using up to 62 shares of CCC water (or more if deemed necessary and <br />provided by the Morgans). See, Letter Agreement between Frank <br />Morgan, Mary Lou Morgan, Mike Morgan (as Lessors) and WFC (as <br />Lessee) dated April 19, 2010, attached hereto as Attachment 3. <br />4. WFC representative Lance Wade met face to face with Mike Morgan on <br />June 16, 2010, to discuss several concerns Mr. Morgan had with the
