Shane Self <br />From: Nusskem, Mark [Mark.Nusskem@dotstate.co.us] <br />Sent: Tuesday, February 02, 201011:32 AM <br />To: sself@enviroag.com <br />Cc: Trevizo, Joe; Marquez, Rudy E <br />Subject: Preliminary approval <br />Shane, <br />Sorry I did not get to this sooner. <br />This is to serve as confirmation of preliminary approval for the bore you intend to place under US 50/287 in the Lamar Area <br />for Colorado Beef Feedyard on SH ROW. <br />A permit will be issued to the Utility owner and the Contractor after meeting the provisions of the application as attached to <br />the link below my name. <br />These considerations will to be known to the bidders. <br />Permittee shall observe all CDOT M&S Standards and CDOT Utility Accommodations specifications in the execution of this <br />work and restore the Right -of -Way to original condition, per current CDOT M & S Standards. <br />Where water, high - pressure gas, or hazardous material pipelines ' are either in /under the roadway or suspended from a <br />highway structure, a casing pipe shall be required. This casing shall be of sufficient size and type to protect the carrier pipe <br />from damage during Installation and provide means of conveying leaking fluids or gasses to points safely beyond the traveled <br />roadway. <br />Unless otherwise specified, buried crossings shall be bored or jacked beneath the roadway, at least from toe of slope to toe of <br />opposite slope. Portals for untrenched crossings more than S feet in depth shall be bulk headed in conformance with OSHA <br />construction and safety standards. Portal limits of untrenched crossings shall be established safely beyond the highway <br />surface and clear zone and in no case shall the lateral distance from the surfaced area of the highway to the boring or jacking <br />pit be less than the vertical difference in elevation between such surface and the bottom of the pit. Water jetting or tunneling <br />is not permitted. Water assisted boring may be permitted, as determined by the CDOT Inspector for borings less than six (6) <br />Inches in diameter. <br />Boring hole shall be oversized to the minimum amount required to allow pull- through of the conduit being installed. <br />Resultant voids shall be grouted or otherwise backfilled, subject to CDOT approval. Ends of bored sections shall not be covered <br />before being inspected. Encasement shall be consistent with Utility Accommodation Code provisions. CDOT may require <br />protective casing for shallow installations or certain conduit materials. Encased crossings shall extend at least from toe of <br />slope to toe of slope, or the full width between access - control lines on freeways, including the Interstate System. All borings <br />equal to or greater than six (6) inches in diameter shall be designed and signed by a registered professional engineer licensed <br />in the State of Colorado. <br />If the proposed work disturbs one acre or more total surface area, a Colorado Discharge Permit System (CDPS) Stormwater <br />Construction Permit is required from the Colorado Department of Public Health and the Environment. The Permittee shall be <br />responsible for obtaining this and all required permits. A copy of a the CDPS, shall be provided to the CDOT Region 2's Permit <br />Office, P.O. Box 536, Pueblo, CO, 81002, at least ten days prior to commencement of the work to validate this Utility\ Special <br />Use Permit. Failure to acquire and provide a copy of the CDPS to the Department shall void this Utiltty\ Special Use Permit and <br />all facilities installed by the Permittee shall be removed from the Right -of -Way. <br />Erosion, sedimentation and water pollution caused by highway construction activities are a concern to the Colorado <br />Department of Transportation (CDOT). <br />Contractor must comply with all applicable permits including Colorado Discharge Permit System (CDPS) permit. Contractor is <br />liable for penalties incurred due to permit noncompliance. <br />Contractor is also liable for damage and repair of construction related erosion, sedimentation and or water pollution as a <br />result of the activities in or adjoining the SHROW. Liability may be up to and including two years from completion of activities. <br />
