Pineda <br />21215 HWY. 52 Director <br />Fort Morgan, CO 80701 <br />RE: Westhoff Pit; DRMS File No. M-1974-094; Technical Revision - 02; Adequacy Review <br />Dear Mr. Westhoff, <br />The Division of Reclamation, Mining and Safety (Division) has completed its adequacy review <br />of your application for the Technical Revision to the above referenced permit. The application <br />was received and called complete for review on June 17, 2010. The decision date for this <br />application is August 19, 2010. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br />The Division has identified several items that will require the submittal of additional information <br />or clarification of the existing information. Inadequacies are identified under the respective <br />corrective actions along with suggested actions to correct them. <br />The operator shall submit a Technical Revision describing how final grading of the site will <br />control stormwater runoff as it enters the drainage channels. The Technical Revision shall <br />describe how stormwater runoff will be routed into both of the drainage channels that leave the <br />mine site. <br />The Operator has proposed building a sixteen (16) foot dam on the southern permit <br />boundary. Any dam which exceeds ten (10) feet in height from the elevation of the lowest <br />point of the natural surface of the ground is considered to be a jurisdictional dam and is <br />therefore subject to review and approval by the Office of the State Engineer (OSE). The <br />Operator should contact OSE for guidance on the design review process. <br />2.
