Dear Mr. Westhoff,
The Division of Reclamation, Mining and Safety (Division) has completed its adequacy review
of your application for the Technical Revision to the above referenced permit. The application
was received and called complete for review on June 17, 2010. The decision date for this
application is August 19, 2010. Please be advised that if you are unable to satisfactorily
address any concerns identified in this review before the decision date, it will be your
responsibility to request an extension of the review period. If there are outstanding issues
that have not been adequately addressed prior to the end of the review period, and no
extension has been requested, the Division will deny this application.
The Division has identified several items that will require the submittal of additional information
or clarification of the existing information. Inadequacies are identified under the respective
corrective actions along with suggested actions to correct them.
The operator shall submit a Technical Revision describing how final grading of the site will
control stormwater runoff as it enters the drainage channels. The Technical Revision shall
describe how stormwater runoff will be routed into both of the drainage channels that leave the
mine site.
The Operator has proposed building a sixteen (16) foot dam on the southern permit
boundary. Any dam which exceeds ten (10) feet in height from the elevation of the lowest
point of the natural surface of the ground is considered to be a jurisdictional dam and is
therefore subject to review and approval by the Office of the State Engineer (OSE). The
Operator should contact OSE for guidance on the design review process.
