Box 680 <br />Frederick, Colorado 80530 <br />RE: S & H Mine; DRMS File No. M-2000-158; Amendment 02, Adequacy Review #2 <br />Dear Mrs. Ortiz, <br />The Division of Reclamation, Mining and Safety (Division) has completed its review of your <br />response to the first adequacy review of the amendment application, Per your request in item <br />#9 of the adequacy review, the decision date has been extended to August 15th, 2010. Please be <br />advised that if you are unable to satisfactorily address any concerns identified in this review <br />before the decision date, it will be your responsibility to request an extension of the review <br />period. If there are outstanding issues that have not been adequately addressed prior to the <br />end of the review period, and no extension has been requested, the Division will deny this <br />application. <br />6.4.3 EXHIBIT C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />1.) Several corrections and additions will need to be made to the Exhibit C map. In order to <br />avoid redundancy, the necessary corrections are discussed in the Exhibit sections below. <br />6.4.4 EXHIBIT D - Mining Plan <br />2.) In response to item #9, the Division will extend the decision date to August 15th, 2010 to give <br />the applicant enough time to obtain approval from the SEO for the Design Report for the <br />proposed embankments. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />3.) In reference to your response to item 16 and 17 of the first adequacy review, please explain <br />how the Operator intends on excavating material from the overburden borrow areas and not <br />lowering the grade in the topography? Will there be enough material to backfill these areas to <br />the original grade adjacent to the floodway? <br />4.) The response to item 17 references the Permanent Erosion Control Plan submitted in <br />Attachment D. However, the information submitted in this attachment are the designs for the <br />Office of <br />Mined Land Reclamation Denver a Grand Junction A Durango Office of <br />Active and Inactive Mines
