Pursuant to Rule 3.02.2(4), the Division has reviewed the
Roadside Portals Mine reclamation liability, in association with this midtenn permit review. we
have prepared an updated cost estimate (enclosed as Attachment 1). The new liability is
$1,722,908.00. This new liability is $82,495.00 more than the current liability of $1,640,413.00.
The reason for this increase is general cost increases since the estimate was last updated with
Permit Renewal No. 5 (completed on September 14, 2007).
