THE U.S. FISH <br />AND WILDLIFE SERVICE IN THEIR LETTER DATED AUGUST 2 , 2009 TO MESA <br />COUNTY PLANNING AND DEVELOPMENT REGARDING THE H LLIBURT N <br />CANTED STORAGE YARD PROJECT HAS SPECIFICALLY REQUESTED THAT THE <br />ACTIVITIES PROPOSED WITH TR- 9 INVOLVING RECLAMATION F THE PONDS <br />NEAR THE COTTONWOOD STAND CONTAINING THE RAPTOR WEST BE DONE <br />OUTSIDE OF THE NESTING PERIOD AND THAT NONE OF THE COTTONWOOD <br />TREES IN THIS STAND BE CUT DOWN, THE PERT ITTEE WILL COMPLY WITH THE <br />U.S. FISH AND WILDLIFE SERVICE RECOMMENDATION TO COMPLETE <br />RECLAMATION ACTIVIES OUTSIDE OF THE NESTING PERIOD TIM FRAME <br />(APPROXIMATELY APRIL THROUGH JULY) AND NONE OF THE COTTONWOOD <br />TREES IN THE STAND SHALL BE CUT DOWN. <br />STATUS: Complied with 6/22/2010. Stipulation No. 24 has been satisfied and this was <br />verified by the Division in two consecutive inspections of the Roadside Portals Kline Unit Train <br />L ad ut area on May 17, 2010 and on June 22, 2010. Re lamati n of the UTL Sediment Fonds <br />1 and 2 has been completed and during the reclamation activities none of the cottonwood trees <br />were cut down. Further, the Cooper's Hawk nest had been blown down by strong winds <br />sometime during the winter prior to the reclamation work at the UTL Ponds. This was <br />documented by Halliburton's consultant vestWater Engineering in their report Halliburtn <br />Cameo Stora a Yard Biological cal Su.rve Re ert dated April 2010. The site of the former <br />Cooper's Hark nest was verified during the May 2010 inspection. Because the rest had fallen <br />and there were no ether signs of activity it was - determined that Halliburt n acted appropriately <br />in commencing with the reclamation work at the U TL Ponds during the April /May timefr me. <br />All reclamation work t the UTL Ponds was completed by June 22, 2 0 10. <br />There are no active stipulations placed on the permit at this tine. <br />SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />The Division does not have any adequacy questions or comments ments regarding this Midterrn <br />Review. <br />SECTION v — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Division has granted, a variance from the approximate original contour (AOC) restoration <br />requirements for steep slope raining at the South Portal facilities area. Steep slopes as defined in <br />Rule 1.04 125) exist in the South Portal disturbed area and they are depicted on Exhibit 6C of the <br />pennit document. As allowed for in Rule 2.06.5, SCC requested an A. C variance with Permit <br />Revision Number PR- for these steep slopes to alloy for an alternative commercial <br />p stmining land use. <br />Within PR-3, SCC requested, and the Division approved, a variance from the approximate <br />original contour restoration requirements for steep slope mining, pursuant to Rules 2.06.5 and <br />Roadside Portals Mine - - July 15, 2010 <br />
