New Elk Coal <br />Company (NECC) is proposing to mine coal within the previously permitted 1989 boundary. <br />This proposed revision does not increase the surface disturbance. <br />Specifically, NECC is requesting permission to mine either the Allen or Apache within the <br />previously permitted 1989 boundary. The apache seam is located approximately 15-30 ft above <br />the Allen seam. The results of the ongoing rehabilitation and exploration will determine which <br />alternative plan is executed. Rehabilitation of the slopes and slope bottom area will be <br />completed in the third quarter of 2010. Mining is planned to commence in the late 3`d or 4th <br />quarter of 2010. <br />If rehabilitation of the old Allen workings are feasible, mine development in the Allen seam is <br />projected to advance east and south of the existing mine workings. Two sets of mains will be <br />advanced to the east of the existing workings to the outer most extent of the 1989 permit <br />boundary. Production panels will be developed using room and pillar mining. Secondary <br />mining is planned where technically feasible and legally allowed. <br />If conditions require mining the Apache rather than the Allen seam, a new slope bottom area will <br />be constructed off the Apache level of the slope to establish a connection to the exhaust fan at the <br />East Portal shaft.. Once that connection is established and ventilation available, the development <br />would continue south by driving two new sets of mains to the south offset so as not to overlie the <br />old Allen seam workings. The mains would turn east towards the Apache Canyon #1 shaft. <br />Mining would then proceed north, south and west of the apache shaft. Multi-seam mining is <br />not proposed at this time. <br />3
