requests that Section 2.05.6(6)(b)(iii) on revised page 2.05-143 be revised to reflect this change. The
Division also requests that a statement be made in this same section that, should mining be proposed
within one mile of the Bruce Park Dam and Terror Creek Reservoir, the subsidence control plan will
be reactivated. The same reference should also be added to the appropriate sections of 2.05.6(6)
which now discuss the subsidence control plan, rather than deleting such text. If BRL wants to
continue monitoring of the Bruce Park Dam and the Terror Creek Reservoir on a voluntary basis, an
appropriate explanation should be placed into the text as well, such as on revised page 2.05-158.
This issue is resolved. The requested revisions were made on revised pages 2.05-43 and 2.05-44 in the
June 1, 2010 submittal.
Section 2.10 Maps and Plans
64. Please revise the currently approved Maps 11, 14 and 27-B to show that the new permit boundary
extends to the west.
This issue is resolved. The three maps were revised in the June 1, 2010 submittal.
Section 3.02.2 Determination of Bond Amount
65. Attached is the Division's reclamation cost estimate for PR-12. The estimate is comprised of eight
tasks (a summary sheet and tasks 251-257) and represents an increase in liability of $45,039.00. This
estimate included the transfer of three exploration holes (BRL-1-03-01, BRL-1-08-01 and BRL-1-08-
04), drill pads, light use roads, topsoil replacement and reseeding from the Bowie No. 1 Mine permit
into the Bowie No. 2 Mine permit. The original Bowie No. I Mine revisions were TR-41 and TR-49.
The Division's estimate is more than the one submitted by BRL because the Division updated the costs
for the tasks from TR-41 and TR-49 in the PR-12 estimate. Please inform the Division in writing
whether or not this estimate is acceptable to BRL.
This issue is resolved. In the June 1, 2010 submittal, BRL accepted the reclamation cost estimate.
Section 4.20 Subsidence Control
66. Under Rule 4.20.2, please provide documentation that owners of property, including structures, and
residents within the area above the underground workings and adjacent areas have received the
mining schedule as described in Rules 4.20.2(1), (2) and (3).
Response not accepted. The Pitkin Mesa pipeline is "property" and will be subsided with a worst case
consequence of separation and/or disruption of the delivery of water. The owner of this structure
requires notification in exact accordance with Rule 4.20.2. Please review Rule 4.20.2 and submit
evidence that the owners of property have been properly notified with at least the minimal information
as required by the Rule.
General Comments Re arding Maps
67.
