Turner & Morgan Letter
July 7, 2010
Page 2
with Ms. Turner. Please make every effort to meet with WFC to discuss and resolve your concerns
directly with WFC.
Ms. Turner has stated numerous times that I cannot understand the issues without my traveling to Nucla
for a meeting with Ms. Turner. I have explained that conflicting schedule and duty obligations have
prevented my travel to Nucla, and I explained in my message today that this will be the situation through
July. As I have explained, I understand the concerns and issues in detail. I have studied the pertinent
files, read and listened to your explanations expressed through many letters, telephone conversations and
voice messages.
Your fourth message of today asks if I can send an alternate representative from DRMS. Based upon
your previous expression of anger, hostile allegations and expressed distrust of the DRMS staff members
familiar with this situation, I engaged directly in this matter, and I will not be sending alternative
representatives at this time.
Since my involvement, and in direct response to your requests and concerns, DRMS has taken the
following actions:
- Directed WFC to temporarily cease all exportation of soil and/or overburden materials from
Morgan Property.
- Directed WFC to cease any new surface disturbance, and consequently any new mining on
Morgan property.
- Verified availability of ongoing permitting documents at the County Courthouse.
- Verified availability of all permitting documents for public review at the mine site (as required
and allowed by law), with the follow -up assurance that if Ms. Turner requests and is denied
access to those documents, DRMS will intervene.
- Provided paper copies of all WFC permit renewal documents free of charge.
- Advised Ms. Turner regarding the immediate availability of all documents through the DRMS
website.
- Directed WFC to coordinate directly with the landowner representatives for the Morgan property
as a direct requirement of PR6, regarding the pending soil management and reclamation issues.
DRMS will continue the work on PR6 and to make every effort to address Ms. Turner's concerns. In the
meantime, we ask that Ms. Turner meet directly with WFC to present and negotiate the ongoing issues
that seem to be based upon conflicts that reside most directly with Ms. Turner (Morgan Property
landowner representative) and WFC.
Sincerely,
David Berry
Director, Office of Mined Land Reclamation
CC: Al Klein, OSM
Jim Fulton, OSM
Lance Wade, WFC
