My return <br />call of today was in response to voice messages received from Ms. Turner on July 5, 2010 (one total) and <br />July 7, 2010 (three total). I also received an additional voice message from Ms. Turner on July 7, 2010 <br />after my return call of 11:25 a.m. today. <br />The messages from Ms. Turner express continued frustration with the pending Western Fuels— Colorado <br />(WFC), New Horizon Mine, Permit Revision Number 6 (PR6). The messages also request that I travel to <br />Nucla to meet with Ms. Turner. <br />The PR 6 process remains open and the decision deadline is extended to August 15, 2010 to allow time <br />for regulatory review, possible additional submittals by WFC and for required discussions to occur <br />between WFC and the Morgan property landowner representatives regarding pending reclamation and <br />permitting requirements. Ms. Turner is both an ongoing objector to PR6 and is a Morgan Property <br />landowner representative. <br />The Division of Reclamation, Mining and Safety (DRMS) has previously acknowledged that Ms. Turner <br />expresses valid concerns regarding past, present and proposed mine soil management and reclamation <br />practices. DRMS understands these issues and we have directed WFC to make appropriate changes to the <br />New Horizon permit through PR6. DRMS has also directed WFC to work with Ms. Turner to address the <br />ongoing issues. <br />DRMS will continue to scrutinize the PR6 submittals for regulatory and legal compliance; however, <br />DRMS cannot unilaterally resolve all of the apparent conflicts between Ms. Turner and WFC.
