Dear Ms. Turner and Mr. Morgan:
This letter is written as follow -up to my voice message left for Ms. Turner at 11:25 a.m. today. My return
call of today was in response to voice messages received from Ms. Turner on July 5, 2010 (one total) and
July 7, 2010 (three total). I also received an additional voice message from Ms. Turner on July 7, 2010
after my return call of 11:25 a.m. today.
The messages from Ms. Turner express continued frustration with the pending Western Fuels— Colorado
(WFC), New Horizon Mine, Permit Revision Number 6 (PR6). The messages also request that I travel to
Nucla to meet with Ms. Turner.
The PR 6 process remains open and the decision deadline is extended to August 15, 2010 to allow time
for regulatory review, possible additional submittals by WFC and for required discussions to occur
between WFC and the Morgan property landowner representatives regarding pending reclamation and
permitting requirements. Ms. Turner is both an ongoing objector to PR6 and is a Morgan Property
landowner representative.
The Division of Reclamation, Mining and Safety (DRMS) has previously acknowledged that Ms. Turner
expresses valid concerns regarding past, present and proposed mine soil management and reclamation
practices. DRMS understands these issues and we have directed WFC to make appropriate changes to the
New Horizon permit through PR6. DRMS has also directed WFC to work with Ms. Turner to address the
ongoing issues.
DRMS will continue to scrutinize the PR6 submittals for regulatory and legal compliance; however,
DRMS cannot unilaterally resolve all of the apparent conflicts between Ms. Turner and WFC. DRMS
reiterates our request that Ms. Turner, as a declared Morgan property representative, meet with WFC
representatives to present and negotiate all of the unresolved issues that seem to exist between the parties.
DBMS made a like request to Mr. Lance Wade last week, and Mr. Wade indicated his willingness to meet
