111111. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This work has been successfully completed and both backfill areas at each pond had topsoil replaced <br /> and the backfill area was scheduled to be seeded with the appropriate seedmix within the next few <br /> days. The reclaimed UTL Ponds 1 and 2 are shown in Photograph No.'s 2 and 3. All of the <br /> reclamation work to date completed at the UTL Loop area looks very good. <br /> Processing Waste <br /> The CRDA waste disposal sites were dry and stable, diversions and perimeter ditches appeared <br /> functional. The temporary coal mine waste storage area atop the CRDA-1 pile was inspected. <br /> Temporary storage of coal mine waste from McClane Canyon Mine and from other ongoing <br /> reclamation activities at the Roadside Mine was approved with MR-75 in 2009. Hauling from <br /> McClane Canyon Mine has been completed. Approximately 2500 tons of coal waste(coaly material <br /> and coal refuse) was hauled from McClane Canyon Mine to the temporary storage area between June <br /> 17 and June 21, 2010. The temporary coal waste storage and handling area is shown in Photograph <br /> No. 4. The coal waste material unloaded on the top of the CRDA-1 pile will be placed and compacted <br /> in the road that was left open for that purpose. Cover material that was originally stripped from the <br /> footprint of the temporary waste pile will be replaced on the disturbed area atop the CRDA-1 pile and <br /> the site reseeded. <br /> Support Facilities <br /> At the South Portal area, we inspected the large lay down area located to the east of the fruit stand and <br /> warehouse. Brant Harrison landowner and operator of the Kokopelli fruit stand has planted peach and <br /> cherry trees at this location as an added feature and attraction for the Kokopelli fruit stand operation <br /> (see attached Photograph No. 5). The facilities area(former shop and warehouse) and perimeter <br /> locations at the South Portal were well maintained. The reclaimed portal area appears well vegetated <br /> with no significant erosion. <br /> The Substation B site was in good condition. The reclaimed areas appear to be fairly well vegetated. <br /> At the North Decline reclaimed area, the mine discharge site (016) was viewed. The discharge from <br /> the mine was flowing at approximately 275 gpm. <br /> At the UTL loop area, Halliburton's contractor FCI was pouring footers for a new bridge across the <br /> lower end of Coal Creek. They were also constructing new rail spurs for the sand off-loading facility <br /> and have removed the sewage lagoons that were used by SCC when the mine was active. FCI was <br /> regrading the site of the former lagoons (see Photograph No. 6). Halliburton is well underway in <br /> constructing the Cameo Sand Offloading Facility and it is evident that an Industrial- Post Mining Land <br /> Use has been implemented at the UTL Loop area. No signs of erosion or instability were noted at any <br /> of the support facility locations during this inspection. <br />
