The reclamation costs are still under review at this time. Your estimate appears to be well prepared; <br />however, the division is required to complete a separate bond estimate as well. Once the remaining <br />adequacy issues have addressed, this will be completed. <br />Noxious weed control will be part of the general operation plan of the pit. Phillips County has a Weed <br />and Pest Management District which offers services that control noxious weeds. Mr. Hansel will either <br />use that service or hire a private operator to spray the noxious weeds after receiving advice on the <br />proper chemical which would offer control. <br />We are aware that the Division will complete an independent cost estimate for reclamation. <br />6.3.5 EXHIBIT E - Map <br />The Site Maps need to depict the access route to the pit from County Road 3 referred to in Exhibit D, <br />statement d). Access routes are considered affected area and must be included in the 9.9 acres <br />permitted. <br />The access route to County Road 3 has been added to Exhibit C - Site Map and highlighted on Exhibit D - <br />Mining Plan and Exhibit E - Reclamation Plan. The route was considered as part of the 9.9 acres when <br />the pit was configured. <br />Thickness of replaced overburden/topsoil should be included on the reclamation maps where it will be <br />replaced. <br />Information on thickness of replaced overburden/topsoil has been added to the map which is Exhibit E- <br />Reclamation Plan. <br />6.3.6 EXHIBIT F - List of Other Permits and Licenses Required <br />One agency that you will need to contact is the Water Quality Control Division of the Colorado <br />Department of Health and Environment to determine whether or not you will be required to obtain <br />storm water permits for your sites. <br />We will contact the Water Quality Control Division of the Colorado Department of Health and <br />Environment concerning the need for a storm water permit. <br />6.3.12 EXHIBIT L - Permanent Man-Made Structures <br />DRMS has noted the waiver allowing the mining activity within 200' of the county roadways. <br />However, what the rule requires (6.3.12 (a)) is a notarized agreement between the Applicant and the <br />County (structure owners) stating that the Applicant will provide compensation for any damages to <br />structures within 200' of the permit boundary. <br />The Phillips County Commissioners are providing a notarized statement that the proposed mining and <br />reclamation activities, as proposed, will have "no negative effect" on their roadway. <br />2
