The reclamation was performed as follows: <br />1985 <br />Approval and construction of Permanent Flood Control Dike <br />2001 <br />Overland Conveyor structures were demolished and removed (included: Transfer <br />buildings 3 and 4, Conveyor Tubes, Linear Stacker, Linear Stacker Rail & concrete, <br />conveyor concrete footers, drive building) <br />2003 <br />Backfilling, regrading and seeding of Overland Conveyor Corridor. <br />2008-2009 <br />Loadout Facility structures were demolished and removed (included: Loadout Building, <br />Coal feeders and 60" conveyor belt structures, water tank, fire suppression building) <br />2010 <br />Coal fines removal, backfilling, regrading and reseeding were completed as per approved <br />final contours (included: Pond 1 and 2, sewage lagoons, new road/bridge construction, <br />new facilities construction). <br />The Unit Train Loadout area has been approved as "Industrial" for its post-mining land <br />use. Snowcap's permit states on page 15-2 that installation of the multimillion dollar sand <br />plant, initiating construction of the bridge and new access road and the configuration of <br />the reclaim tunnel as a storage facility would be sufficient to demonstrate that the <br />alternative land use has substantially commenced and is likely to be achieved. All of <br />these items have been initiated or completed. <br />The ten-year minimum period of responsibility in regard to revegetation does not apply. <br />As per DRMS's rule 4.15.10(3), enclosed is the landowner's request to waive the <br />vegetation requirements of rule 4.15.10(2).
