PERMIT #: M-1989-023 <br />INSPECTOR'S INITIALS: ECS <br />TMRPP(`TTONJ T)ATP- hma 7Q ?nln <br />approval. <br />PROBLEM/POSSIBLE VIOLATION: Problem: Current approved mine plan states that the disturbed area will be less than 1 acre and <br />that there will be a 8 foot face of sand and gravel exposed. Obviously this is not the existing condition on site at this time - see included <br />site photos. The current mine plan needs to be updated and clarified pursuant to C.R.S. 34-32.5-112 (1)(c)(VI). The operator must <br />provide sufficient information to describe or identify how the operator intends to conduct the operation. <br />CORRECTIVE ACTIONS: This issue may also be addressed through the same permit amendment process as the bonding and <br />hydrologic balance issues. DRMS believes that this would certainly be the most efficient way to bring the site back into compliance. If <br />no amendment is submitted, site will need to be brought back into compliance with the current plan or a technical revision submitted to <br />DRMS for approval. If a revision is chosen, the operator shall submit a Technical Revision, with the required $216 revision fee, to <br />update and clarify the current approved mine plan to reflect existing and proposed activities by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 9/29/2010 <br />INSPECTION TOPIC: Revegetation <br />OBSERVATIONS: Topsoil stockpile is vegetated almost exclusively with cheatgrass, which is a listed noxious weed. Cheatgrass is <br />also present over much of the permitted area. <br />PROBLEM/POSSIBLE VIOLATION: Problem: This is a problem for failure to employ weed control methods for state listed noxious <br />weed species within the permitted area, and to reduce the spread of weeds to nearby areas as required by section 3.1.10 (6) of the rule. <br />CORRECTIVE ACTIONS: Implement approved weed control plan and provide proof to the Division that this has been done. If a <br />weed control plan is not already in place, The operator shall develop a weed control and management plan in accordance with Section <br />3.1.10 (6) of the Rule. This plan should be developed in consultation with the county extension agency, or weed control district office <br />and should include specific control measures to be applied, a schedule for when control measures will be applied and a post-treatment <br />monitoring plan. This weed control plan may also be included in a new permit amendment as previously described. If not part of a <br />permit amendment, this weed control plan shall be submitted to the Division as a Technical Revision to the approved plan with the <br />appropriate Technical Revision fee of $216.00, by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 9/29/2010 <br />OBSERVATIONS <br />Due to presence of large highwall and constraints of current 5.4 acre permit boundaries, site is currently underbonded and <br />cannot be reclaimed as stated in approved reclamation plan without expanding outside of current permit boundary. <br />Permittee stated that they wish to expand permitted area from 5.4 acres to the upper limit of 9.9 acres for a 110c permit. <br />This will need to be done through the permit amendment process. DRMS believes that an appropriate permit <br />amendment to increase permit acreage, submitted by the required corrective action date of 9/29/10, would be an <br />excellent way to address the mulitple problems with mining plan, bonding and other issues noted and listed in this <br />inspection under a single corrective action. <br />(FN) Financial Warranty: <br />Narrative: Due to presence of large highwall and constraints of current 5.4 acre permit boundaries, site is currently <br />underbonded and cannot be reclaimed as stated in approved reclamation plan without expanding outside of current permit <br />boundary. <br />(HB) Hydrologic Balance: <br />Narrative: Large areas of standing water were observed on site during the inspection. See included photos. <br />(MP) Gen. Compliance With Mine Plan: <br />Narrative: Current approved mine plan states that disturbed area will be less than 1 acre and that there will be a 8 foot <br />face of sand and gravel exposed. Obviously this is not the extisting condition on site at this time - see included photos of <br />site. This issue may also be addressed through the same permit amendment process as the bonding and hydrologic <br />balance issues. If no amendment is submitted, site will need to be brought back into compliance with the current plan or a <br />technical revision submitted to DRMS for approval. <br />(RD) Roads: <br />Narrative: Roadways used to access the permit area must be included in the total permit acreage.
