OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Financial Warranty <br />OBSERVATIONS: Due to presence of large high wall and constraints of current 5.4 acre permit boundaries, site is currently <br />underbonded and cannot be reclaimed as stated in approved reclamation plan without expanding outside of current permit boundary. <br />PROBLEM/POSSIBLE VIOLATION: Problem: The financial warranty is not adequate to reclaim the site in accordance with the <br />approved reclamation plan. This is a failure to maintain the proper financial warranty amount to complete reclamation of the affected <br />lands pursuant to C.R.S. 34-32.5-117(4)(b) of the Act <br />CORRECTIVE ACTIONS: The operator shall submit an amendment to the existing permit within 90 days which will also address the <br />issue of adequate financial warranty, as determined by the Division. If the operator does not submit an amendment to the existing <br />permit, the Division will send a separate surety increase notice to the operator regarding the required increase of the financial warranty. <br />The operator will have 60 days from the date on the surety increase notice to post the additional financial warranty. <br />CORRECTIVE ACTION DUE DATE: 9/29/2010 <br />INSPECTION TOPIC: Hydrologic Balance <br />OBSERVATIONS: Large areas of standing water were observed on site during the inspection. See included photos. <br />PROBLEM/POSSIBLE VIOLATION: Problem: The site is improperly impounding surface drainage/runoff. By rule, storm water <br />cannot be retained onsite for longer than 72 hours. <br />CORRECTIVE ACTIONS: Submit documentation from the State Engineer's Office demonstrating that the impoundment of water on <br />this site is authorized by that office. Operator could also remove impediments to proper surface drainage. Any water leaving the site <br />will need to be approved by CDPHE through an approved storm water management/discharge permit. This issue may also be <br />included/corrected in the permit amendment process <br />CORRECTIVE ACTION DUE DATE: 9/29/2010 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />OBSERVATIONS: Current approved mine plan states that disturbed area will be less than 1 acre and that there will be a 8 foot face of <br />sand and gravel exposed. Obviously this is not the existing condition on site at this time - see included photos of site. This issue may <br />also be addressed through the same permit amendment process as the bonding and hydrologic balance issues. If no amendment is <br />submitted, site will need to be brought back into compliance with the current plan or a technical revision submitted to DRMS for <br />Page 1 of 6
