M. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood represented <br /> the operator. <br /> Selected photographs taken during the inspection are attached to the end of this report. With the <br /> operator's consent, this report was issued from the Denver office of DRMS. <br /> The longwall was active near the west end of E-Seam Panel 1. The ground was dry. The inspection <br /> focused on the following areas: the future location of the buttress at the toe of Refuse Pile Expansion <br /> East (RPEE), surface facilities areas in Sylvester Gulch, reclaimed methane drainage well (MDW) <br /> sites along West Flat Iron Road in E '/2 Section 27, active construction areas on and near the Lower <br /> Refuse Pile, and reclaimed areas in Lone Pine Gulch. <br /> Signs and Markers <br /> Topsoil markers were properly displayed in all areas inspected, including MDW pads. The disturbed <br /> area perimeter of MDW pads and their roads are not marked by signs. The perimeter of the area <br /> disturbed at each pad is readily recognized by a cut-slope on the uphill side of the pad and an earthen <br /> berm and its outslope of downcast material on the downhill side of the pad. A sign on each wellhead <br /> marks the identifying number of the MDW, and the perimeter of the disturbed area of each pad is <br /> recognized by the area of disturbed ground that is within about a 200-foot radius of the wellhead. The <br /> disturbed area perimeter of the MDW roads is readily identified by the road right-of-way. DRMS is <br /> reviewing recently submitted Minor Revision 366 for the applicable requirements for marking the <br /> areas affected by surface operations at MDW sites and MDW roads (Rule 4.02). <br /> Roads <br /> Road surfaces were well-maintained in Sylvester Gulch, the Sylvester Gulch Road Extension, and on <br /> roads leading to methane drainage well sites. No signs of excessive erosion were found on road <br /> embankments. <br /> Hydrologic Balance <br /> Sediment was being removed from Freshwater pond#2 (see photo). Pond 002 contained a pool of <br /> water(see photo), but was not discharging(discharge is controlled by a gate valve). <br /> Construction has been completed in the last few months on the following structures approved in TR- <br /> 119: new pond MB-5E, a 48-inch diameter HDPE pipe that was buried and will feed runoff to pond <br /> MB-5E, a bridge across the North Fork that provides access to pond MB-5E, and a concrete-lined <br /> sediment sump next to the construction site of stacktube ST-5 (site of recently removed pond MB-2R). <br /> Pond MB-5E was built at the same location as former pond MB-5 (which was the Bear Mine pond), <br /> and replaces pond MB-2R which recently was removed.
