III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Basil Bear represented the <br /> operator during a portion of the field inspection and during the records check. <br /> East Mine <br /> The operator was doing ditch and silt fence maintenance during the inspection. Also, surface disturbance <br /> markers were being put back up since the backfilling had been completed.The sediment control system at the <br /> main gate area was in place. There was no standing water in any of the four bin wall ponds. The two road <br /> culverts near the west ridge waste pile had been removed for reclamation. The riprapped ditches across the <br /> backfill and along the road were in place. <br /> The backfilled slopes showed no signs of slope instability. There were no indications of erosional instability as <br /> well, although a couple of road sections were starting to show signs of rilling. The upper backfilled benches, <br /> except above the utility bench,have not been seeded yet but are holding up well due to the roughened surface. <br /> The lower benches have a moderate vegetative cover. <br /> The west ridge waste pile was well vegetated. The waste pile's slopes and benches were stable. The waste pile's <br /> sediment pond was dry and the discharge pipes were in place. The old waste pile was also well vegetated and <br /> appeared to be stable. <br /> West Mine <br /> The road up to the west mine was dry and passable. Both mine id signs were up,one at the former entrance to <br /> the mine and one at the entrance to the reclaimed fan site. Surface disturbance markers were up as well.The <br /> backfilled slopes appeared to be stable, with no erosional or slope stability problems observed. The vegetative <br /> cover was fair to moderate. There was no standing water in either of the two sediment ponds. <br /> Run-of-Mine Stockpile(Reclaimed) <br /> The operator was putting up more surface disturbance markers around the backfilled and vegetated disturbed <br /> area.A good vegetative cover was present. There were no signs of erosional gullying or slope instability. The <br /> graveled entrance road was in very good condition and the cable was across the road. The mine id sign needs to <br /> be put back up on its post. Silt fence was in place,although the operator was planning on making some repairs. <br /> The sediment pond was dry. The pond embankment was well vegetated and pond spillways were functional. <br /> Unit Train Loadout <br /> The three entrances to the site were open,with mine id signs up at each entrance. Surface disturbance markers <br /> were also up..The sediment control system was functioning properly.The central diversion ditches and culverts <br /> were in place.The collection ditches and pond were also in place.The sediment pond was dry. There was a tree <br /> branch that had fallen into the pond's bin wall emergency spillway and needs to be removed. The diversion <br /> ditches and culverts above the pond were functioning properly. There was no activity on site. <br /> 1 <br />
