Wally Erickson <br />June 28, 2010 <br />Page 8 <br />12. Section 6.3.3(1)(c) states, "No more that 5, 000 cubic yards of nonacid producing <br />ore will be stored on the Mayday No. 1 bench. . . . " Please note that such <br />statements, in the approved permit, may become enforceable permit conditions. <br />Response to Adequacy Issue No. 12: Wildcat Mining has deleted the "5,000 cubic <br />yards" reference from the permit application text. See Attachment 11-Exhibit C-Mine Plan. <br />13. Section 6.3.3(1)(c) of AM-01 states, "No more than 25,000 tons of <br />rock will be sampled or developed from the No. 2 portal ...... <br />Pursuant to Rule 1.1(27), all 110(2) operations are restricted to <br />producing less than 70, 000 tons of mineral, overburden, or <br />combination thereof per calendar year. This limitation on <br />production applies to the entire site, each year. When providing <br />information on production, please specify tonnages of mineral (ore) <br />and overburden (waste rock), or clarify that the quantity includes both <br />mineral and overburden and represents total production. <br />Response to Adequacy Issue No. 13: The term "25,000 tons of rock" will be <br />deleted from the permit application text. The permit application language will state, "more <br />than 99% of the mined rock (70,000) tons will be returned to the mine for disposal in a <br />stope or crushed and utilized as road base. The remaining 1% mined rock will be processed <br />offsite. This is discussed in the existing permit application, and clarifying information will <br />be provided. See Attachment 11, Exhibit C-Mine Plan. <br />14. Section 6.3.3(1)(c) ofAM-01 states, "Ventilation has been approved by <br />the Mine and Safety and Health Administration and will be <br />implemented in accordance with MSHA criteria and guidelines. " As <br />noted previously, please show the underground openings for the <br />ventilation facilities on the maps and discuss these openings in the text. <br />Response to Adequacy Issue No. 14: As explained in the mine plan for the existing <br />permit, the Chief Portal has been left open to provide a man way for the May Day Mine. <br />Primary ventilation for the underground workings is provided through Portal No. 1 at the <br />May Day Mine. Wildcat Mining has revised its base maps to depict the location of the <br />Chief Portal. See Attachment 9. <br />15. Section 6.3.3(1)0 ofAM-01 states, "All areas of disturbances are pre-existing. <br />Approximately 3 acres of the permit area have been disturbed as a result of <br />previously milling and mining activities (Exhibit E-2). " Pursuant to Rules 6.3.3(1) <br />and 6.3.5(2)0, please outline and label these existing disturbances on the <br />appropriate maps. <br />Response to Adequacy Issue No. 15: The proposed disturbed areas for the Lamb <br />(May Day No. 3), and May Day No. 1 and 2 are illustrated on Exhibit E-4, attached hereto <br />as Attachment 15.
