Pineda <br />Director <br />Nucla, Colorado 81424 <br />R: J-Birds Mine, Permit No. M-2005-050, Amendment AM-01, Environmental Protection Plan Approval. <br />On May 13, 2010 the Division of Reclamation, Mining, and Safety (DRMS) received Rimrock Explorations responses to <br />review issues for the required Environmental Protection Plan (EPP) submitted as Amendment AM-01. Staff review of <br />the responses finds no additional issues. Therefore AM-01 for the inclusion of an EPP is approved. <br />The Permit File now reflects: <br />• Permitted acreage increase to 7.5 acres of surface disturbance at the mine portal area, monitor well and future <br />vent pads. <br />An Environmental Protection Plan as required by Rule 6.4.20. The plan has a radiometric survey of exisiting <br />conditions, geo-chemical analysis of waste and uranium ore rock, and an established monitor well program. <br />The plan notes: <br />a) Existing radiometric conditions note the area has a historical mining history so reclamation will be <br />returned to exisiting average levels or better as recorded. <br />b) Ore and base materials in the ore storage area will be placed back in the mine upon reclamation. <br />Materials will be removed until readings are back to established baseline radiometric readings or <br />bed rock is reached. <br />c) Reclamation will include topsoil and vegetative cover to prevent or retard precipitation infiltration <br />on dump areas. <br />d) All monitor wells must be constructed and operational with the first reports submitted no later <br />than October 1, 2010. By Rule, five (5) full quarters must be monitored and reported. Rimrock <br />must submit reports within 10 working days of sampling. If the dry trend continues, DRMS staff will <br />review an operator request to change the sampling frequency through a technical revision <br />submission. <br />e) An engineered stormwater control plan to hold a 10 year / 6 hour event and pass a 100 year / 24 <br />hour precipitation event that prevents storm water run-on and retains storm water runoff from the <br />site. <br />No ore shall remain on site for longer than 180 days. If the mine goes into a temporary shutdown ore must be <br />removed or placed back in the mine prior to the shutdown date. <br />• The mine is noted as having intermittent status. This means there is a potential the site will be active for less <br />than 180 days per year.
