III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 15 June 10 <br /> Pg 1/12 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. This inspection was also a complete oversight inspection of the Colowyo <br /> Mine conducted by Christine Belka of the Office of Surface Mining in Denver. The <br /> inspection was conducted on 15, 16 and 17 June 2010. Christine Belka of OSM was <br /> present on all three days of the inspection. Ryan Pawlowski of CCC accompanied <br /> me on the inspection on the morning of 15 June 2010 and all day on 16 June 2010. <br /> Jennifer Sekulski-Barton accompanied me on the afternoon of 15 June 2010 and all <br /> day on 17 June 2010. The weather was warm and sunny on all three days of the <br /> inspection. It was breezy on all days, with heavier winds on 17 June 2010. Although <br /> Colowyo has had a fair amount of precipitation over the past few weeks, the ground <br /> was dry at the time of the inspection. The mine was active mining but was not <br /> hauling coal to the loadout (due to the ramp-down in production and the large coal <br /> stockpiles from the scheduled outage at the Tri-State Craig Station, Colowyo is <br /> generally only hauling coal to the loadout at night). Colowyo was not actively <br /> loading a train at any time during the inspection but trains were seen going from the <br /> mine to the Craig Station on two mornings. <br /> Availability of Records: - All of the Colowyo records are located in their records room, <br /> which is in the main office building. The blasting records are kept in the blasters <br /> office. The records were checked on the morning of 16 June 2010. All of the <br /> necessary records were available. Please see the DBMS Availability of Records form <br /> at the end of this inspection for more details regarding the Colowyo records. <br /> Signs and Markers: - The mine ID sign was in place at the main entrance to the mine <br /> as well as the entrances to the four ponds along Colorado Highway 13 (Streeter, <br /> Gulch A, Prospect and Section 28). These signs contained all of the necessary <br /> information, including mine name, permit number and contact information. On the <br /> morning of 17 June 2010 the Division conducted its AVS Annual Review Inspection, <br /> per the AVS MOU. The appropriate form was given to Johanna Cramer of DBMS. <br /> - Stream buffer zone signs were in place along Taylor Creek and along Goodspring <br /> Creek at the location of the highway sediment ponds (Streeter, Gulch A and <br /> Prospect). <br /> - The entire mine permit area is defined by barbed wire fencing. There are no <br /> trespassing and blasting area signs periodically along the fence. <br /> - All of the topsoil stockpiles along Haul Roads A and B have a "topsoil stockpile" sign <br /> in place. There are also numerous topsoil stockpiles along the East Side Collection <br /> Ditch and the Streeter South Side Ditch. These piles also had their "topsoil stockpile" <br /> signs in place. <br />
