The Colowyo Coal Company shall submit a TECHNICAL revision to <br />the Division which provides an analysis of groundwater points of <br />compliance at the Colowyo Mine pursuant to Rule 4.05.13(1). This <br />analysis will be done in consultation with the Division and will <br />include a written determination of the need for groundwater points of <br />compliance at the mine. If deemed appropriate, based on this analysis, <br />Colowyo shall establish one or more points of compliance for the <br />Colowyo Mine. <br />10. Prior to disturbing any lands along the Wilson Creek the Colowyo <br />Coal Company shall provide the Division with a detailed analysis and <br />discussion of the Alluvial Valley Floor (AVF) that has been <br />documented in the area. Colowyo must also provide a detailed plan <br />for the restoration of the AVF if and when it is disturbed. This <br />analysis may be in the form of a stand-alone revision or it may be <br />contained in the revision required in Stipulation 3. Any revision <br />submitted must be approved by the Division prior to any disturbance. <br />13. No later than 4 January 2010 the operator will submit a complete <br />technical revision application addressing establishment of tall shrub <br />and aspen planting areas in appropriate site locations of the post-2008 <br />original permit area and the South Taylor reclamation area. The <br />revision application should address the following: <br />minimum size of individual planting area (not less than 1 acre); <br />minimum cumulative planting area acreage (not less than 20 acres <br />for aspen/tall shrub planting sites on thick soils, and not less than 20 <br />acres for tall shrub/bitterbrush planting sites on thin soil). Both aspen <br />and tall shrubs can be planted within the same thick soil planting sites; <br />• at least %2 of the total acreage of planting sites will be over graded <br />spoils, and none of the sites will be located in close proximity to <br />undisturbed native habitat; <br />• detailed seeding and planting plans for the various sites. Planting <br />plan should address species, planting densities, planting methods, size <br />and source of planting stock (native wilding, commercial <br />containerized, etc.). Appropriate low competition seedmixes will be <br />specified for the thick soil and thin soil planting sites, respectively; <br />fencing specifications to exclude ungulates; <br />specification for weedguard fabric or equivalent to suppress <br />herbaceous competition in immediate proximity of planted seedlings, <br />and; <br />• site locations, site conditions, and soil thickness specifications for <br />each proposed planting area.
