RIDER TO MINING PERMIT <br />Permit Date: November 5, 2007 <br />Permit No: C-1981-019 <br />The following additional stipulations form an integral part of the foregoing permit: <br />Stipulation No. <br />Description <br />2. Prior to disturbing any lands in the Lower Wilson area, the Colowyo <br />Coal Company shall provide the Division with a PERMIT revision <br />containing a mine plan and a reclamation plan and any additional <br />baseline monitoring information (surface water, ground water, soils, <br />vegetation, etc.) requested by the Division. The approval of Permit <br />Revision 02 is only an approval for disturbance in the South Taylor <br />Pit (South Taylor Pit, West Valley Fill, East Valley Fill and associated <br />structures). NO DISTURBANCE IS APPROVED FOR THE <br />LOWER WILSON AREA WITH THE APPROVAL OF PERMIT <br />REVISION 02. <br />3. Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on seven <br />areas identified as requiring more detailed study in the October 1984 <br />report titled "Cultural Resources Investigations in the Danforth Hills <br />Proposed Coal Lease Area; Moffat and Rio Blanco Counties, <br />Colorado; Consolidation Coal Company". These areas are as follows: <br />5MF1652, 5MF1935, 5MF1937, 5MF4003, 5MF4010, 5MF4011 <br />AND THE Bison Bone IN THE CUT-BANK. The additional study <br />data will be forwarded to the Colorado Historic Society for their <br />evaluation and a determination of the proper course of action required. <br />4. Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on the <br />six areas identified on Map 16A as "unsurveyed areas". Additionally, <br />Colowyo will be required to survey any other areas that are <br />determined to have no survey or inadequate survey data. The six <br />unsurveyed areas shown on Map 16A are all within Township 4 <br />North, Range 93 West, and are basically described as follows: SW'/ <br />SW'/ Section 15; SW'/ SW'/ Section 22; SE`/ NE'/o Section 28; <br />SW'/ SE'/ Section 28; E`/2 NW'/ Section 33; W%2 SW'/ Section 33. <br />The additional study data will be forwarded to the Colorado Historic <br />Society for their evaluation and a determination of the proper course
