Permit M-1977-342 (Henderson Mine and Mill) <br />TR-09 - Record of Completion of all Stipulations <br />of the 1-Dam seepwater canal (see attachment 5). DRMS approved the request in a letter dated April <br />18, 2002 (see attachment 6), with the following conditions: <br />1. Upon completion of the construction, a written certification for the new sections of pipeline will be <br />provided to DMG in accordance with Rule 7.3.2 of the Hard Rock/Metal Mining Rules and <br />regulations of the Mined Land Reclamation Board. The pipes will not be placed back into <br />service until the certification has been accepted by DMG in accordance with Rule 7.3.2(1). <br />2. The annual leak-down test on the pipelines required under the terms of the Technical Revision <br />TR-09 will be conducted as soon as feasible following the completion of the discharge point <br />relocation project. <br />CIVIC provided written certification for the new section of the pipeline and the results of the leak-down <br />test in a letter dated May 23, 2002 (see attachment 7). <br />Stipulations #3 and #4 <br />Stipulation (#3) <br />Within 60 days of completion, a grouting report will be provided for the 2-Dam decant system grouting <br />operation. The report will detail the installation of the grout, include a description of any problems that <br />occurred and their resolution, and will include compressive strength test results from the cured grout <br />samples. <br />Stipulation (#4) <br />The penetration of No. 3-Dam by the abandoned No. 2-Dam decant system could create a pathway for <br />seepage and piping which are potential dam stability issues. With 60 days of the date of TR-09 <br />approval, Henderson must provide the Division with a report on this potential, which may comprise <br />records on the construction of No. 3-Dam as they relate to the decant system penetrations, or if <br />adequate historical records are available Henderson must provide the Division with a proposal to <br />investigate the nature and condition of the decant system penetrations. <br />Completion of Stipulations #3 and #4 <br />CIVIC submitted to DRMS documentation that addressed Stipulations 3 and 4 in a memo dated August <br />14, 2000 (see attachment 8). The following supporting documentation related to the this submittal are <br />also attached for your reference: (1) June 16, 2000 construction summary of the 3-Dam decant grouting <br />project from Denver Grouting (see attachment 9); and (2) August 10, 2000 report addressing possible <br />3-Dam stability issues related to the abandonment of the 2-Dam decant system (see attachment 10). <br />CIVIC submitted to DRMS a subsequent memo dated November 21, 2000 (see attachment 11) <br />regarding grout compressive strength re-test results which were completed due to the initial test results <br />being deemed invalid. DRMS stated in the December 1, 2000 inspection report (the actual inspection <br />took place November 14, 2000) that the decant line project had been successfully completed. <br />CMC believes that the information provided and/or referenced in this submittal fulfills the requirements of <br />stipulations numbers 1, 3 and 4 detailed in the April 27, 2000 conditional approval letter and subsequent <br />April 18, 2002 conditional approval to relocate the 3-Dam seepwater discharge point. CMC understands <br />that completion of annual pipeline integrity tests is an ongoing requirement of stipulation number 2. Upon <br />review and approval, CIVIC requests that DRMS send written acknowledgement that the above <br />stipulations have been fulfilled. <br />Page 2
