CMC is in the process of reviewing its DRMS <br />permit files to make sure that all associated commitments have been met and that the related files, <br />correspondence and authorizations are complete. As is practicable, our goal is to obtain written <br />confirmation that obligations associated with each of our technical revision and permit amendment files <br />have been satisfied. We believe this will prove useful to both CMC and DRMS, and we appreciate your <br />assistance with this effort. <br />CMC submitted the request for TR-09 on April 11, 2000 (see attachment 1) and DRMS subsequently <br />granted CMC conditional approval on April 27, 2000 (see attachment 2). The purpose of TR-09 was to <br />grout a portion of the abandoned 2-Dam Decant System and to install parallel gravity lines to route No. 3- <br />Dam seepage to the No. 1-Dam seep water collection system. The conditions imposed by DRMS were in <br />the form of the following stipulations. <br />Stipulation #1 <br />Stipulation <br />The 3-Dam seepage pipelines will not be put into service until the Division has issued written <br />acceptance of the certification of the facility as required under Rule 7.3.2(2) of the Hard RocWMetal <br />Mining Rules and regulations. The certification shall be accompanied by a construction report that will <br />detail the installation of the pipelines, including pipe and valve specifications, a description of the inlet <br />structures, seepage barriers and south dike reconstruction, a description of any problems that occurred <br />and their resolution, and a description and test results of pipeline integrity testing. <br />Completion <br />Henderson provided DRMS with final certification in a letter dated January 12, 2001 (see attachment 3). <br />DRMS provided the go-ahead to remove the old 3-Dam pump station concurrently with finalization of <br />the seepwater project in a memo dated May 9, 2001 (see attachment 4). <br />Subsequently, in a letter dated April 11, 2002, CMC requested approval from DRMS to relocate the 3- <br />Dam seepwater discharge point from just upstream of the Ute Park Station seepwater inlet to the head
