EXHIBIT S - Permanent Manmade Structures <br />MAP S-1: Vicinity of pit showing manmade permanent structures. <br />General (Refer to Sheet S-1): <br />1. only one occupied dwelling, a mobile home on the operators/landowner's <br />own property, and inside the current and proposed permit area, is within 200 <br />feet of the edge of the affected area. <br />2. Mining activities are limited by the County Conditional Use Permit to 10 acres <br />actively mined at one time: plant and pond areas, traffic (roads) and areas in <br />process of reclamation are additional. <br />3. The Right-of-Way and all known utilities, as well as the roadbed of SH-160 <br />(southeast of the site) are more than 200 feet from the edge of the affected <br />area, except for a portion of those structures which were approximately 110 <br />feet from the original permitted area, according to current aerial <br />photography and information. Therefore, these areas are presumed to be <br />grandfathered and no request for an indemnification and damage <br />agreement has been made to Colorado Department of Transportation, <br />Empire Electric Association, or Qwest Communications, has been made as <br />part of this amendment application. <br />2. This Exhibit is the engineering evaluation as required by the Colorado Division of <br />Reclamation, Mining, and Safety, prepared by Nathan A. Barton, CE, PE, DEE, a <br />licensed Professional Engineer in the State of Colorado, in the case that owners of <br />permanent manmade structures within 200 feet of proposed affected land are <br />unwilling to enter into an indemnity and damage agreement with the operator. <br />1. Based on my (the engineer's) inspection of the site, the proposed mining <br />operational activities and reclamation activities proposed, and inspection of <br />similar operations in the vicinity with similar soil, topography, and other <br />features, I (the engineer) hereby certify that the significant, valuable or <br />permanent man-made structures are not expected to be damaged or <br />negatively affected by activities occurring at the mining operation. <br />2. There are a number of permanent manmade structures within 200 feet of the <br />affected area, some of which extend beyond that 200-foot limit. All <br />significant, valuable or permanent man-made structures inside the permit <br />boundary have been analyzed for their significance, value, and <br />permanence, and are included in this evaluation. <br />3. All fencing inside the property is considered temporary and expendable by <br />the landowner. As necessary, all roads within the permit boundary or 200 feet <br />of the affected lands are planned for rebuild and repair as necessary at the <br />end of mining activities. <br />4. Soils: The soils on which the various permanent structures and the mining area <br />itself are located are variable, with data available from NRCS (National Soil <br />Survey) and in part included in Exhibit I. These soils exhibit no characteristics <br />which are expected to increase potential for failure due to mining as <br />proposed; there is no significant potential for shrink-swell, slope limitations <br />beyond the angle of repose of the loose materials, increased erosion, or mass <br />movement at the proposed 2H:1 V slopes, <br />5.
