allow farm equipment and typical ranching vehicles and equipment to access <br />all portions of the site. <br />Notice of other backfill (3.1.5(9)) <br />The Applicant will comply with this requirement to notify the Division if other <br />backfill is used. Use of clean construction debris, such as soil, subsoil, waste rock, <br />overburden, clean Portland or asphaltic cement concrete rubble, for backfill, to <br />be covered by soil as appropriate for intended post-mining use, is proposed. No <br />acid-bearing materials, tailings, or other toxic or potentially toxic materials shall <br />be used. When in doubt, standard characterization methods shall be used to <br />evaluate the suitability of such materials for use on site. Records of off-site <br />sources of backfill material shall be maintained for the life of the operation, in <br />accordance with CDRMS requirements, including notarized certification <br />statements as needed. <br />Prevention of unauthorized release of pollutants to surface water (3.1.5(10)) <br />The Applicant will handle chemicals, equipment, materials, and mined material <br />to be disposed of on-site in a way to prevent unauthorized release of pollutants <br />to surface water, and comply with this requirement. Fuel and lubricants will be <br />managed in accordance with requirements of the DRMS "Oil and Fuel Spill <br />Containment Structures" memorandum of 8 April 2005. <br />Prevention of unauthorized release of pollutants to groundwater (3.1.50 11) <br />The Applicant will comply with this requirement in the same manner as to <br />prevent surface water release, above. <br />General water hydrology and water guality (3.1.6(1)) <br />Hydrology and water quality issues are addressed at length in Exhibit G. The <br />Applicant will comply with applicable water and water rights laws and <br />regulations, and water quality laws and regulations. No dredge or fill in waters of <br />Colorado or the United States is proposed, and no temporary or large siltation <br />structures will be placed except as required by permits,z and will be removed in <br />accordance with those permits. No storm water structures are proposed which <br />are intended to retain storm water for longer than 72 hours. <br />Earth dams (3.1.6.(2)) <br />Mining will be done only in areas which will not present potential for negative <br />impact on the stability of any off-site earth dams. Except for storm water control <br />systems in and around plant areas, there will be no additional earth or other <br />dams constructed beyond those existing on the site as of 2010. Any additional <br />temporary or permanent water retention or detention basins will contain less <br />than 1.0 acre-feet of water at any time, including immediately following 24-hour, <br />25-year storm events and will have dam crest heights of less than 10 feet, except <br />as approved by the Colorado Division of Water Resources.
