The Applicant appears to have partially addressed adequacy items 10 and 14 of the Office's April 28th <br />correspondence. The Office has not received any response from the Applicant to adequacy items 1, 2, 3, <br />7, 8, 9, 11, 12, 13, 15, 16, 17, 19, 20, 21, 22, 23, 24, 25, 26 and 27. <br />As noted above, the decision date for AM-01 is July 5, 2010. On July 5, 2010, the review period for the <br />application will close and the Office will issue its decision to approve, approve with conditions or deny the <br />application for AM-01. Please respond to the adequacy issues in a timely manner, by June 28, 2010, to <br />ensure adequate time for the Office to complete its-review process and render a decision. <br />Pursuant to Rules 1.6.2(1)(c) and 1.6.2(2), please ensure that a complete copy of the application and all <br />responses to the adequacy issues are placed with the La Plata County Clerk and Recorder's Office and <br />made available for public review. <br />As previously noticed, the Division of Reclamation, Mining and Safety has reason to believe a violation <br />exists regarding the re-opening and construction of the Chief Portal and has scheduled the matter for <br />consideration by the Board on July 12, 2010. <br />Please contact me at the Division's office in Durango at 691 County Road 233, Suite A-2, Durango, <br />Colorado 81301, phone (970) 247-5469, if you have any questions. <br />Sincerely, <br />Wallace H.
