Martin <br />Executive Director <br />In a correspondence dated April 28, 2010, this Office enumerated 28 adequacy issues for AM-01 at the <br />May Day Mine, which must be addressed to the Office's satisfaction prior to the decision date. In that <br />correspondence the Office set the decision date for AM-01 at July 5, 2010. During the May 13, 2010 <br />meeting of the Mined Land Reclamation Board (Board), the Board ordered the Applicant to address all <br />adequacy issues identified in the April 28th correspondence, with the exception of items 4, 5, 6, 18 and 28, <br />by July 5, 2010. <br />In its April 28th adequacy letter, under items 10 and 14, the Office requested that the application identify <br />surface features of the proposed operation, including all underground openings for ventilation purposes. <br />On May 7, 2010, Mr. Clements hand delivered a single copy of a map titled, "Wildcat Mining - Level 1, <br />Ventilation and Escape Way Plan", prepared by Jim Sheridan and dated December 24, 2009. The map <br />identifies the Chief Portal as a ventilation and secondary escape way for the Level 1 workings. <br />Accordingly, the Chief Portal is affected land. Pursuant to Rule 1.4.2(2)(b)(ii), please provide two <br />additional copies of the map. Please update the applicable exhibits of the application to provide the <br />information required under Rules 3.1, 6.2 and 6.3 for the Chief Portal. Please identify any additional <br />underground openings for the other two levels of the proposed operation. <br />Since the Chief Portal is located outside of the proposed permit boundary it must be incorporated into the <br />boundary of affected lands. This incorporation constitutes an Amendment to the application. Please <br />review Rules 1.1(4), 1.1(6) and 1.8 for the Amendment process. Please ensure that the Amendment to <br />AM-01 addresses the applicable portions of Rules 3.1, 6.2.1, 6.3.1 (Exhibit A), 6.3.2 (Exhibit B), 6.3.3 <br />(Exhibit C), 6.3.4 (Exhibit D), 6.3.5 (Exhibit E), 6.3.6 (Exhibit F), 6.3.7 (Exhibit G), 6.3.9 (Exhibit 1), 6.3.10 <br />(Exhibit J) and 6.3.12 (Exhibit Q. Pursuant to Rule 1.6.6, submittal of the Amendment to AM-01 will <br />require the application to be re-noticed and all applicable deadlines of the review process shall begin to <br />run anew.
