2.04 3 -7 "Historic land use" ALL Lies 1.04(71) Land use is what the land is used for NOT the <br />vegetation cover. Most all. of NH2 has been HISTORICALLY used as cropland. 1.04(60) lands <br />that have been used for cropland ANY 5 out of 1.0 or more years preceding the acquisition <br />1.04(x) cropland is land used for production of adapted crops for harvest grasses or legumes <br />included but not limited to row crops, small grains, HAY, orchards, or grasses raised for <br />PRODUCTION. There are VERY FEW irrigated pasturelands in NH2. Most all of'these farms <br />were irrigated cropland. Here is the problem and compliance with rules 1.04. Whenever WFC <br />applied for a permit for NH2, they must at that time do a pre -mine land uses inspection and <br />classify ALL of these areas according to the choices given. to them in 1.04 Those choices were <br />and still are (a) cropland (b) pasturelandC rangeland, these are the only ones that apply. "These <br />choices along with their definitions should have been used to EXACTLY what they say they <br />mean and are. They violated all of this and since then, so has the State Words irrigate has been <br />added to them words like management has been added, soil depths, etc. This is ALL wrong. <br />Here is how we do it. All of NH2 within the permit area, Morgans, .Johnsons, San Miguel <br />Power, Staats, Martins, Bensons, Garveys, Burbridges, etc. All of these farms should have been <br />classified immediately as cropland by definition. All of these farmers had crops used for harvest <br />and production and it did not matter if it was grass, grass /alfalfa/ alfalfa Oat hay, none of this <br />mattered or matters. Cropland does not have to be prime farm land. Prime farmland must be <br />cropland but not vice - versa. Some fauns are dryland that are cropland. These farmers all got 2 <br />and 3 cuttings of HARVEST EVERY year. All of these farms had the mechanical means for <br />their harvest and their lands were all harvested along with irrigation, fertilization , tilling, etc. <br />Their. ENTIRE properties may not have been used for PULL production as ours, but the land was <br />used to produce hay for their cattle and sheep and it was something that was done EVERY <br />YEAR not occassionally. Some place had some pasture but most of them were hayed every year. <br />Small pastures for a few head of horses or a dairy cow or two or a few goats might have existed <br />on their properties, but they were consistently hayed for harvest and production.. The farmers in <br />the spring moved the livestock off irrigated, fertilized, and harvested as many cuttings as the <br />property would allow 2, 3 and sometimes we got 4. The livestock would return in the fall and the <br />grazing would begin again until snow flew and then feeding what they had produced would <br />begin. All of this classifications should have been very simple and if the farmers had been asked . <br />and given the PROPER definition and asked which applied to them, they would have been told <br />WFC and the STATE at that time and this would never be happening now. WFC is trying every <br />way possible to put down the ,farmer and the farms that they have worked so hard to keep. This <br />in itself should be a violation of all Federal and State laws under Protecting the landowner and <br />his rights. <br />Page 2.04.3 -7 <br />`tin most cases pre-mine irrigation methods utilized :flooding the land using gravity" Side rolls <br />which are more efficient" None of this is true. Si.deroll irrigation also uses Gravity? DA141 <br />Mr. Morgan has not flood irrigated this place for 39 years. Most of us used gated pipe, big guns, <br />or furrows. All of these were and still. are very efficient ways of irrigating.. Weimer Ranches has <br />over 30,000 acres and one of the largest landowners in this country and they do not own a side <br />
