///. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood, and <br />Rozellyn Hall represented the operator. <br />Selected photographs taken during the inspection are attached to the end of this report. With the <br />operator's consent, this report was issued from the Denver office of DRMS. <br />The longwall was active near the west end of E-Seam Panel 1. The ground was dry. The inspection <br />focused on methane drainage well (MDW) sites in panels E-1 and E-2. This is the first inspection in <br />2010 during which these MDWs have been fully accessible by vehicle, as road clearing at the higher <br />elevations of the mine could not begin before May 1 due to USFS restrictions. <br />Signs and Markers <br />Topsoil markers were properly displayed in all areas inspected, including MDW pads. The disturbed <br />area perimeter of MDW pads and their roads are not marked by signs. The perimeter of the area <br />disturbed at each pad is readily recognized by a cut-slope on the uphill side of the pad and an earthen <br />berm and its outslope of downcast material on the downhill side of the pad. A sign on each wellhead <br />marks the identifying number of the MDW, and the perimeter of the disturbed area of each pad is <br />recognized by the area of disturbed ground that is within a 200-foot radius of the wellhead. The <br />disturbed area perimeter of the MDW roads is readily identified by the road right-of-way. DRMS is <br />reviewing recently submitted Minor Revision 366 for the applicable requirements for marking the <br />areas affected by surface operations at MDW sites and MDW roads (Rule 4.02). <br />Roads <br />Road surfaces were well-maintained in Sylvester Gulch, the Sylvester Gulch Road Extension, and on <br />roads leading to methane drainage well sites. No signs of excessive erosion were found on road <br />embankments. <br />Hydrologic Balance <br />Ditches next to roads appeared in good repair. <br />No discharge was occurring at the underground mine water pumping site in Sylvester Gulch (CDPS <br />outfall 017). <br />Middle Flume on Dry Fork of Minnesota Creek was in good condition. The operator has recently <br />removed a beaver dam from the site. Flow through the flume was around one foot deep. Beaver dams <br />cause flow in much of Dry Fork to be spread across the valley bottom rather than being confined to a <br />well-defined channel. <br />3
