III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />The vegetation throughout the mine site has greened up and cool season species were actively growing. <br />The inspector identified several patches of Perennial pepperweed along the northern drainages in the <br />Moffat Pit reclamation block. These pepperweed patches were discussed and identified on a map with <br />the contractor. <br />Perennial pepperweed N flank of PM-2 .................... Small patch of pepperweed between PM2 & PM1 <br />Areas sprayed with Milestone herbicide in the fall of 2009 were inspected. The treatment appears to <br />have been effective. Few thistle plants are re-emerging in these previously invested areas. A few thistle <br />are emerging at the bottom of Moffat final pit drainage (MFPD) and Down Drain #4 drainages <br />immediately to the east of the pond. The number of plants is considerabley reduced from the infestation <br />identified in July 2009. Re-treatment of this area was discussed with the pesticide contractor. He <br />indicated that this area was already on their schedule to treat. We also discussed the need to document <br />what location they had sprayed accurately on an appropriate map. <br />Pesticides being used during this June treatment include a mix of Tordon 22K, 2,4-D, and <br />MSO(surfactant) for control of Houndstongue and thistle species. A blue dye is added to give the speay <br />crew a visual confirmation od which areas have been treated. A mix of Telar (or Escort), and 2,4-D will <br />be used for control of White top. Thecontractor had not begun to treat for White top at the time of the <br />inspection. The contractor did not state which chemical treatment would be used for Perennial <br />pepperweed. <br />No weed infestation were observed in the West Ridge reclamation block. While an occasional <br />houndtongue plant was present, the distribution was diffuse enough that the Division did not visioally <br />observe this species to be considered an infestation in the West Ridge area. When noxious species are <br />present in a high frquency, in concentrated patches, or interrupt to post-mining land use, weed control <br />measures are necessary. <br />Hydologic Balance: SE-30 seep to the Moffat pond was flowing at a very low rate, estimated at <l gpm. <br />The Spoil springs located south of the Moffat pond are flowing heavily to the Moffat pond.
