• 2.05.3 <br />(iii) The haul and access road construction will not alter or relocate any drainage <br />ways so no response is required. <br />(iv) The inlet end of all culverts and ditch relief drains will be protected by an end <br />section or a rock or concrete headwall. <br />(v) The applicant seeks to have the Division approve conducting the proposed <br />surface coal mining activities within 100 feet of the right -of -way fine of old <br />State Highway 133 under Rule 2.07.6(2)(d)(iv). It is assumed the right -of- <br />way line for ofd State Highway 133 is the invert of the borrow ditch. The <br />surface coal mining activities within this right -of -way include sediment pond <br />B & D, a portion of the haul road, portions of the haul road to the gob pile, <br />the gob pile sediment pond, the gob pile topsoil pile and the gob pile cover <br />fill stockpile. The toe of the gob pile is close to being within 100 of the right - <br />of -way. <br />All of the surface coal mining activities are located on surface owned by the <br />applicant. The applicant owns most of the land on both sides of the road <br />• where these surface coal mining activities are to be located. The applicant <br />also own most of the land south of the railroad tracks. The surface coal <br />mining activities adjacent to this land include a portion of the haul road. <br />Margie Hamilton owns bare undeveloped land west of sediment pond B. <br />The type of surface coal mining activities located within the 100 foot right -of- <br />way should not affect the two adjacent landowners or the public. Sediment <br />ponds and topsoil stockpiles should not be a problem to the adjacent <br />landowners or the public. The haul roads within the 100 foot right -of -way will <br />be gravel surfaced or paved and watered and cleaned as necessary to <br />control fugitive dust emissions to protect the interests of adjacent landowners <br />and the public. <br />Coal spillage from haul trucks is most often caused from overloaded or <br />uneven loading.
