Lack of secondary containment for fuel tank located in the "Middle Mining Area". <br /> <br />CORRECTIVE ACTION: Submit to this office photo documentation that demonstrates that <br />secondary containment has been constructed prior to May 24, 2010. <br />RESPONSE: A secondary container 14` in diameter x 3' deep has been constructed in <br />which to place the existing fuel tank (See photos). <br />2. The mine identification sign and permit boundary markers are not in compliance with rule <br />3.1.12. <br />CORRECTIVE ACTION: Submit to this office photo documentation that signs and markers <br />compliant with the requirements of Rule 3.1.12 have been properly placed prior to May 24, <br />2010. <br />RESPONSE: The existing sign showing permit # M-86-002 has been attached to the <br />entry gate. New signs have been ordered from Bud's Signs showing permit # M- <br />1996-076 and shall replace the existing signs (See photos). <br />Boundary markers around the middle mine area were found to be in place (See <br />photos). <br />Previously existing boundary markers on the north mine area were not found and <br />apparently have been destroyed by construction of the new Ute Water pipeline, and <br />shall be replaced. <br />3. The slopes of the topsoil stockpiles were steeper than the required 3H:lV. <br />CORRECTIVE ACTION: The topsoil must be re-configured with slopes no steeper than <br />3H:1V and if the stockpile is to remain at this location through the next growing season it <br />must be seeded with an approved seed mix or other effective method no later than May 24, <br />2010. Please provide this office with photo-documentation that shows that the topsoil <br />stockpile meets the requirements of Rule 3.1.9. <br />RESPONSE: The topsoil and overburden stockpiles are being re-sloped to 3H:1 V. <br />The re-sloped stockpiles shall be seeded with an approved seed mix this fall as per <br />your recommendation. Photo-documentation shall be provided after seeding is <br />completed.
