This activity will be
conducted by Four Corners. Some of this fencing needs to be removed to allow the final
center pivot path to be established. It is believed that this will not happen at the worst case
reclamation scenario, but will happen as the area is about to be mined. No new fencing is
planned as part of the reclamation plan since the irrigated pasture area will be continuous.
The perimeter of the Cugnini property is fenced and no new fencing still allows him to run
cattle in his land. Grazing will not be conducted until the bond is released.
Gas Welland Pipeline Work
Approximately 800 feet of gas pipeline will need to be relocated to be able to mine within
Mining Area 4. If this pipeline is not moved than the mining operation will not be able to
proceed into Mining Area 4. If and when the pipeline is moved a new route will already be
installed to prevent any downtime to the gas company. It is believed that the removal and
installation of any pipeline should not be included in the reclamation bond because the new
line will be installed prior to the existing line being removed and it is not a requirement of the
reclamation plan to remove the existing pipeline.
Attached with this letter is the proof of filing with the county clerk.
Exhibit N, Source of Legal Right to Enter
A copy of the notarized Stephenson Letter of Intent is attached.
Exhibit R Proof of filing with the County Clerk and Recorder
Attached are the last two signed receipts from the La Plata County Clerk and Recorder
stating the information that was sent the Divisions office was also submitted to the La Plata
County Clerks and Recorders office to be place on public file.
