The issuance of this permit does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors (hereinafter "Board") in accordance with Rule 18. 3) Approved pursuant to CRS 37-90-137 (2) and (11) for the construction and operation of a well (gravel pit ground water pond) exposing and diverting ground water tributary to the Piedra River at a point where water is available for appropriation. This gravel pit is known as the Tierra Piedra Gravel Pit, Colorado Division of Reclamation Mining & Safety, permit no. M-2009-081. 4) The use of ground water, in addition to evaporation, is limited to water lost in the mining of product. No other use of ground water is allowed unless a permit therefor is approved. Water from this well shall not be used for human consumption without separate approval from the Board. 5) The average annual amount of ground water to be appropriated for evaporation shall not exceed 15 acre-feet with the total surface area of ground water exposure limited to 4.8 acres. The total production of product is limited to 24,000 tons per year. The total average annual amount of ground water to be appropriated for all approved uses including evaporation shall not exceed 15.71 acre-feet. 6) No pumping equipment shall be installed within the confines of this well unless a variance is granted by the Board. 7) Pursuant to Policy 2000-4 of the Board (as amended October 1, 2002), the minimum construction standards in Rule 10 of the Water Well Construction Rules shall be waived for gravel pit ground water ponds; however, compliance with Rule 10.1 and its subsections 10.1.2, 10.1.4, 10.1.6 and Rule 10.2 and its subsection 10.2.1 is required. The owner of the gravel pit shall take necessary means and precautions to prevent contaminants from entering the gravel pit ground water pond. 8) Pursuant to Rule 17.1.4 of the Water Well Construction Rules, the owner shall submit, after initiation of construction, site plan and cross section drawings on 8-1/2" X 11" paper showing the extent of intended excavation, the maximum depth of the pit, and the initial static water level. The owner shall also provide the initial date of ground water exposure in the pit. 9) The boundaries of the gravel pit ground water surface area exposure shall be more than 600 feet from any existing well, completed in the same aquifer that Is not owned by the applicant. 10) The owner shall mark the well in a conspicuous place with well permit number(s) and court case number(s) as appropriate.
