III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 18 May 10 <br /> :50� <br /> Pg 1/7 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 18, 19 and 20 May 2010, Ryan Pawlowski of CCC <br /> accompanied me on the inspection. The weather was cool and raining on 18 and <br /> 19 May 2010 and sunny on 20 May 2010. All of the snow has melted at the Colowyo <br /> Mine but the ground was wet and muddy in spots due to the recent rain. The mine <br /> was active mining but was not hauling coal to the loadout or shipping coal, due to a <br /> scheduled outage at the Craig Station. <br /> During the inspection we met and discussed several issues regarding ongoing <br /> revisions. These discussions included looking at the information Colowyo plans to <br /> submit in response to Technical Revision 81, which is a redesign of the two permanent <br /> excess spoil fills in the South Taylor Pit. We also discussed Technical Revision 84, which <br /> is the tall mountain shrub and aspen planting areas in the South Taylor Pit. Finally, we <br /> discussed some of the requirements for Phase I, II and III Bond Releases. Colowyo is <br /> planning on submitting several bond release applications this summer. <br /> Signs and Markers: - The mine ID sign was in place at the main entrance to the mine <br /> as well as the entrances to the four ponds along Colorado Highway 13 (Streeter, <br /> Gulch A, Prospect and Section 28). These signs contained all of the necessary <br /> information, including mine name, permit number and contact information. <br /> - Stream buffer zone signs were in place along Taylor Creek. <br /> - The entire mine permit area is defined by barbed wire fencing. There are no <br /> trespassing and blasting area signs periodically along the fence. <br /> - All of the topsoil stockpiles along our travel route have a "topsoil stockpile" sign in <br /> place. <br /> Roads: - The main haul road/access road was dry at the time of the inspection. The <br /> road is a paved road and is well maintained and in good condition. <br /> - Colowyo has completed the remaining work on the new South Taylor haul road <br /> (approved through Technical Revision 76). Now that the road is complete, Colowyo <br /> must provide the Division with a construction report and the road must be certified by <br /> a registered, professional engineer, pursuant to Rule 4.03.,1(1)(d)(i). This construction <br /> report and haul road certification must be submitted in the form of a Technical <br /> Revision. The haul road is partially an in-pit road (the portion that is within the limits of <br /> the West Pit) and partially a haul road that must be designed and certified pursuant <br /> to Rule 4.03,1 . The South Taylor Haul Road was well maintained and appeared to be <br /> stable at the time of the inspection. No erosional problems were noted on the road <br /> at the time of the inspection. <br />
