NELSON AND HELEN C. NELSON, here- <br />inafter termed the "Owners," and THE WATER USERS ASSOCIATION <br />OF DISTRICT NO. 6, a Colorado nonprofit corporation, hereinafter <br />termed the "Water Users"; <br />WITNESSETH: <br />WHEREAS, the mining company has purchased from the Owners <br />certain sand and gravel in place described on a map attached <br />hereto, marked "Exhibit A," in Sections 20, 29 and 30, Township <br />2 North, of Range 68 West of the 6th P.M., in Weld County, <br />Colorado, and has applied for a special use permit from Weld <br />County and the State of Colorado; and <br />The mining company is principally responsible for <br />completion of mining and reclamation plans. submitted to Weld <br />County, such plans consisting of a letter from Leonard Rice <br />Consulting Water Engineers, dated June 24, 1974, and such other <br />documents, maps and plans as have been filed with and approved <br />by Weld County; and <br />The Owners are required to furnish augmentation <br />water to compensate water users in Water Division No. 1 for <br />anticipated evaporation losse$ and changes in increased water <br />usage in the area covered by Exhibit A as a result of the <br />mining and reclamation; and <br /> <br />..?
