Hall, P.E. <br />Division Engineer <br />We have been contacted by Todd Williams concerning Nelson Ponds. As you are aware, statute provides that <br />gravel pit operations in the Boulder Creek drainage can be augmented under an agreement with the Water Users <br />Association of District No. 6 if they meet the criteria provided for in 37-90-137(11) (a) (1) C.R.S. We are aware that <br />Nelson Pits are augmented under an October 7, 1974 agreement (copy attached). Mr. Williams has provided us an <br />update concerning the final layout of the pits. Based on the information he submitted, we can affirm that all the <br />unlined gravel pit evaporation is being augmented under the October 7, 1974 agreement. Further, Bob Carlson, <br />our water commissioner for District 6, is aware of replacement under the agreement. <br />Well permit 37646-F has also been issued for 65 acres of exposed ground water surface area at the site since <br />1980. The actual post 1980 exposed ground water surface area is 67.4 acres. Thus, a new well permit is required <br />to reflect this area.
