Operator failed to post the required financial warranty and, therefore, the permit was never <br />issued. <br />5. In December 2008, The Operator re-noticed the application and the matter was <br />scheduled for the Board's February 2009 meeting. <br />6. Before the February 2009 hearing, the Division discovered that the Operator <br />had constructed and was using the unpermitted road to conduct mining activities. The Board <br />therefore found the Operator in violation for mining without a permit (violation MV-2009- <br />007), and did not approve the Idaho Mill's permit application. The Board ordered the <br />Operator to amend the Idaho Mill permit application to incorporate the unpermitted access <br />road by September 7, 2009. In August 2009, Wildcat sought and was granted an extension <br />of time until November 13, 2009 to complete the permit application. <br />7. In September 2009, the Division discovered that the Operator was using the <br />unpermitted access road in support of mining activities at the May Dray Mine. This resulted <br />in another Board hearing and violation in November 2009. The Board found the Operator in <br />violation of a previously issued Cease and Desist Order, mining violation MV-2009-033. <br />The Board ordered the Operator to incorporate the unpermitted road into an approved <br />reclamation permit within 180-days from the Order's issue date. The Order issued on <br />December 10, 2009, therefore the deadline is June 8, 2010. <br />8. At the November 2009 hearing, the Board also found that the interim $56,233 <br />financial warranty for the Idaho Mill, M-2006-069, subject to forfeiture. The Board <br />authorized the Division to proceed with forfeiture proceedings if the Operator failed to <br />comply with the corrective actions (getting the unpermitted road included in an approved <br />reclamation permit) by June 8, 2010. <br />9. Also, during the November 2009 hearing, the Operator withdrew its <br />application for the Idaho Mill. <br />10. The Operator filed a new permit application for the Idaho Mill site (changing <br />the name to the Idaho Mine) on January 21, 2010, file number M-2010-003. Through this <br />application, the Operator attempts to address the corrective actions required by MV-2009- <br />007 and MV-2009-033. The Operator eventually filed approximately 737 pages of text and <br />26 oversized maps and drawings in support of the application. After providing the Operator <br />time to correct deficiencies, the Division determined the application complete for the <br />purposes of filing on May 7, 2010 and set a June 7, 2010 decision date. <br />11. Turning to the May Day Mine, in March 2007, the Division approved the <br />site's permit transfer to the Operator. <br />12. At a November 12, 2009, hearing, the Board found the Operator in violation <br />for constructing an unpermitted mine portal at the May Day site, MV-2009-035.
