<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />V) <br />X <br />JUN 01 2010 <br />Division o7 Kecwa"tion. <br />Mining and Safety <br />ORDER <br />IN THE MATTER OF WILDCAT MINING CORPORATION'S REQUEST FOR AN <br />EXTENSION OF TIME TO COMPLETE CORRECTIVE ACTIONS AND RELATED <br />MATTERS, File Nos. M-2006-069 and M-1981-185 + <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on May <br />13, in Grand Junction, Colorado for a hearing to consider Wildcat Mining Corporation's (the <br />"Operator") request for an extension of a corrective action due date and resulting <br />modification to an in place Cease and Desist Order. This Order applies to the Idaho Mill, file <br />number M-2006-069, and the May Day Mine, file number M-1981-185. Mining consultant <br />George Robinson and Christopher Neumann, Esq. appeared on behalf of the Operator. <br />Wally Erickson and First Assistant Attorney General Cheryl Linden appeared on behalf of <br />the Division of Reclamation, Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise <br />fully informed of the facts in the matter, enters the following: <br />FINDINGS <br />1. The Board has jurisdiction over this matter pursuant to §§ 34-32-104 through <br />107, and 124 of the Colorado Mined Land Reclamation Act, § 34-32-101 et seq. C.R.S. <br />(2009). <br />2. The Operator is in the process of applying for a reclamation permit for the <br />Idaho Mill site, a 9.8-acre section 110(2) underground hard rock gold and silver mine, file <br />number M-2006-069. The Operator is also attempting to update an existing section 110(2) <br />reclamation permit for the May Day Mine site, file and permit number M-1981-185. Both <br />sites are accessed by the same unpermitted road. The road's construction and subsequent <br />use, among other things, has resulted in multiple violations and appearances before the <br />Board. <br />3. Both sites are located in Section 28, Township 36 North, Range 11 West, 10th <br />Principal Meridian. The sites are near the town of Mayday, in La Plata County, Colorado. <br />4. In 2006, the Operator filed a permit application for the Idaho Mill site, M- <br />2006-069. The Division approved the application after a lengthy review process.
