working closely with both parties during the course of mining this site to accommodate the <br />parties involved. The plan will be developed as mining is progressing. <br />16. The San Isabel Electric Power Line relocation will now be shown on both the Mining Plan Map <br />and the Reclamation Plan Map. The consultant forgot that the Relocation of the San Isabel <br />Power line should appear on the Mining Plan Map and the Reclamation Plan Map. This <br />discrepancy was the consultant's mistake. <br />17. The offset distance that San Isabel Electric Association needs is a minimum of I o feet each way <br />of the centerline of the poles. The consultant talked to Mr. Bryan the Right of Way for the San <br />Isabel Electric Association on May 21, 2010 and he confirmed that the easement is proper and <br />that Exhibit "A" is good for them. <br />18. The concerns of the Division of Reclamation, Mining and Safety relating to the permanent man- <br />made structures have been all been address by the applicant/operator with the parties involved. <br />Please see all of the attached agreements to validate this assertion. The agreements have all been <br />notarized as is mandated by the CONSTRUCTION RULES and REGULATION of the Division <br />of Reclamation, Mining and Safety. The applicant has agreements with all the owners the <br />permanent man-made structures. They are QWEST Corporation, San Isabel Electric <br />Association, Inc., and the County of Huerfano; Mr. Edward Pino has been Notified and is in the <br />process of returning the signed and notarized agreement. <br />19. The ranch fence affidavit concerning the any damage to the fence is attached to this letter. <br />20. The agreement with the Huerfano County Commissioners concerning the unimproved county <br />road is enclosed with this review reply. Moreover, this situation has been discussed earlier in <br />this reply. <br />21. Concerning The C.I.G. gas pipeline that was mentioned in the original narrative. It was an error <br />made by the applicant's consultant a C.I.G. gas pipeline is neither on site nor with-in 200 feet of <br />the 112c permit boundary. <br />We look forward to your review comments.
