III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 18 May 2010. The weather was cloudy and the mine <br /> site was dry during the on-the-ground inspection. Brian Watterson of Twentymile Coal Company <br /> accompanied the inspection with Joe Shoemaker joining the inspection. <br /> The longwall was operating as permitted in panel 17 Left of the western mining district. No drilling <br /> activities were in progress during the inspection. Coal was not being loaded out during the inspection. <br /> Signs and Markers <br /> Mine Identification signs were in place and exhibited the required information. Topsoil markers were <br /> noted in the required locations. Disturbance markers (red and white painted roof bolts) delinated the <br /> approximate locations of disturbances. <br /> Additional stream buffer zone markers have been installed per the Divisions request at appropriate <br /> locations around the train loadout area. <br /> Roads <br /> Haul roads and access roads were stable and in good condition at the time of the inspection. The <br /> 61VIN road will require grading as some rutting was observed during the inspection. Roadside ditches <br /> throughout the facilities area were stable and no problems were noted. Roadside ditches were in <br /> compliance at the time of the inspection. <br /> Hydrologic Balance <br /> Ponds G, F, E, C, B, D, and 61VIN were observed during the inspection. Pond 61VIN was holding runoff <br /> water with no pumping from 10RT occurring. Pond D was discharging and water was flowing from Pit <br /> 1 to Pond D. All Ponds embankments were stable and well vegetated at the time of the inspection. <br /> Pond F showed a trickle discharge at the time of the inspection. <br /> No discharge was occurring from the Fish Creek Bore Hole Site 115. <br /> The sump on the north side of the access ramp at Pond B will need to be addressed to clear sediment <br /> to ensure proper functionality of the culvert in to Pond B. This area will need to be maintained to <br /> ensure proper runoff to Pond B and to avoid impacts to Foidel Creek. <br /> A 4" piezometer is installed at the 10RT site with no readings taken to this point due to magnetization <br /> of the casing. TCC personal stated that the freeboard is at -66 feet. <br /> Site 62 (Fish Creek Tipple pond) was discharging at the time of the inspection. TCC personal stated <br /> that the V-notch weir will be replaced in the future. Currently the discharge is measured using 5 <br /> gallon bucket. <br /> The collection ditch on the north side of the 61VIN SAE will need to be cleaned and reestablished to <br /> ensure proper runoff from the site. Rills were observed along the embankments toward the outlet of <br /> the ditch into the collection pond that should be addressed. <br />
