For the purpose of this SWSP a 4% moisture loss <br />was calculated to account for the resulting moisture content of aggregate. The estimate of the total <br />moisture losses was based upon the projected washing schedule associated with the projected <br />aggregate sales. The consumptive use for the washing is 30.4 acre-feet (Appendix A). Return flows <br />from the aggregates washing is delivered back to a settling pond on the Riverbend East site. The <br />evaporation from the settling pond is accounted for in the original SWSP approved on October 27, <br />2009. The total lagged depletions from April 2010 through October 2010 are 69.5 acre-feet. <br />The lagged mining depletions for the combined SWSP are shown on attached Table 1. <br />Replacements <br />The proposed source of replacement water is fully consumable water leased from the City of <br />Aurora. The Applicant has an agreement with the City of Aurora ("Aurora") whereby Aurora will <br />continue to make releases of reusable effluent up to a maximum volume of 249 acre-feet for the <br />Lafarge SWSPs. The applicant will account for a transit loss of 0.5% per mile from the Metropolitan <br />Waste Water Treatment Plant to the gravel pit sites. The transit losses for each site are shown in the <br />table below. Lupton Pit 19 9.5% <br />Lupton Lakes 14 7% <br />The total lagged mining depletions and replacements are shown on attached Table no. 2. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section 37-90-137(11), <br />C.R.S., subject to the following conditions: <br />1. All conditions listed in the original SWSP approved for the Lafarge South Platte Combined <br />SWSP on October 27, 2009 remain in effect except as modified herein. A copy of the original <br />approval is attached for your reference. This amendment does not alter the approval period of <br />this plan, which is April 1, 2010 through October 31, 2010 unless otherwise revoked or modified. <br />If this plan will not be made absolute by a water court action by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257/pit) for <br />each gravel pit no later than August 31, 2010. <br />2. A well permit for industrial use must be obtained for well nos. 1657-RR, 2819-F, 19944-FR, <br />20317-R and 20583-R in accordance with §37-90-137(2). The provisions of §37-90-137(2) <br />prohibit the issuance of a permit for a well to be located within 600 feet of any existing well, <br />unless the State Engineer finds that circumstances so warrant after a hearing in accordance
