It would not be <br />quite as bad as it is except for when we asked Lance not to take our soils, he made that statement <br />that this was a communist state and those who have , give and those who don't, take. This made <br />it a deliberate act of misconduct as well as negligence on the operators part to take care of our <br />prime soils. I think all of you are at the wrong end of the stick. Prior to the Mine shutting off <br />water and prior to permit renewals, I think the State should take pictures of all properties that are <br />going to be mined. The laws state that because farming is a seasonal thing that ALL pictures and <br />ALL documentation must be done during FULL production periods. NOT in MARCH, Not in <br />NOVEMBER, NOT in late fall or early spring as ALL documentation by the State as well as <br />WFC has done in the past. All documentation and pictures must be taken during harvest season <br />or growing season. This has been done wrong and documented wrong by both the State and <br />WFC since the beginning. If all of you could see all of this prior to permit renewals or the <br />granting of permits, there would be an entire different view of our lives and property. This might <br />protect the landowner much better. <br />And as to past wrongs, if the State would have just come up here while our topsoil was still <br />stacked and not spread on Bensons, we could have gotten it back. We begged, but there it went. <br />Someone will have to pay for all of that soil because of the negligence and deliberate act of <br />removal and the violation of all rules and laws, I'm sorry about that, too. But, the landowner <br />should not have to just accept what has happened and live with it. It's not the same . And it was <br />a tremendous loss. <br />Thank you again and I know most things can be worked out between us and WFC. If WFC will <br />just be up front and give us a chance to know what's going on. If they had done back then what <br />they are doing now, there would have never been any major complaints.
