III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Dan Hernandez and Rob Zuber of CDR MS. The mine no longer extracts coal, <br /> but the remaining surface pit(Pit B)is permitted to dispose of flyash. The weather was coal and calm and mostly sunny. <br /> The mine site was wet due to precipitation on the preceding day and night(CEC staff estimated that the storm produced 4 <br /> inches of snow and they measured 1.46'of precipitation in a rain gage). Present at the inspection were Don MacDonald and <br /> Danny Kipp of Coors Energy Company. <br /> Records were inspected and found complete and up to date. Checklist is provided below. <br /> Sims and Markers: Several markers were observed along the east, north and west borders and appeared to be close enough <br /> together. Division will review rules and determine if a mine identification sign is needed at the northeast comer. <br /> Ro=ds: Road side ditches along the haul road are in good shape. The haul road is in good condition and well graded <br /> although some roads were not accessible due to mud from recent rain and snow. <br /> Hydrologic Balance, Pond 42 contained approximately 6 inches of water from recent precipitation. The Dugout Pond was <br /> dry. Pit B contained approximately 6 inches of water from recent precipitation. The drainage ditch along the northem <br /> boundary was in good condition (see photo below). It was well graded and well vegetated.
