III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was a complete quarterly inspection of the mine site and office records, conducted by Dan Mathews of the <br /> DRMS Grand Junction office, accompanied by Dennis Bugay of Seneca Coal Company(SCC). The winter <br /> snowpack had just recently melted off most areas of the reclamation, with remnant drifts in a few north slope and <br /> shaded swale locations. Weather was clear and mild on 4/27, very windy on the morning of 4/28, with rain and <br /> snow flurries beginning late in the day. Roads were soft in some locations, but we were able to access <br /> significant areas of the mine, including sediment ponds 005, 006, 016/016A, and 017. Ponds 009 and 015 in the <br /> Sage Creek watershed could not be accessed due to remnant drifts. Likewise, access was prevented to upper <br /> portions of the 016 and 017 watersheds for the same reason. <br /> Availability of Records <br /> Records were checked on the morning of 4/30, and were found to be on file and up to date through the 1 st Qtr, <br /> 2010. The status of Routt County special use permits (SUP)for II-W is not entirely clear. The currently active <br /> SUP applies to highwall mining operations through 2014, but in fact all coal extraction has ceased at ll-W, and <br /> remaining activity is limited to reclamation and maintenance. According to Rebecca Bessey in the Routt County <br /> Planners Office, special use permits are typically required only through the life of active mining. Ms. Bessey <br /> indicated that her office would research the matter further, and advise SCC(and DRMS)of their determination <br /> regarding the SUP status and need for any further action. <br /> The air emission permit#82R0542F has been cancelled by the Air Pollution Control Division (APCD), and a <br /> letter of cancellation is on file. Adam Wozniak of APCD confirmed in a follow-up phone conversation that an <br /> APCD permit is not required unless there areactive extraction or processing operations. <br /> Siqns and Markers <br /> Mine I.D. signs had not yet been pdated with the correct SCC physical address and phone#as requested in the <br /> previous inspection. Operator indicated that stickers with the corrected information were on order and would be <br /> applied to Mine I.D. signs as soon as possible upon receipt. <br /> Roads <br /> Spring maintenance had recently been initiated on roads which had dried sufficiently to allow for such work, <br /> including Road "G"and the Tie Across Haul Road. Most and other roads and associated drainage ditches were <br /> still too muddy in various locations to allow for maintenance work to proceed. <br /> Road"G" <br /> • The Road "G"ditch relief drain that discharges near the outlet of Culvert G-3 had recently been properly <br /> riprapped as requested in the DRMS inspection report dated 1/4/10. <br /> • Minor scour along Road "G"ditch segment directly north of the Pond 005 inlet. Ditch relief drain off the <br /> road fill into a side drainage north of the road in this immediate vicinity was previously lined with turf <br /> reinforcement mat(TRM). There had been some side scour along the east bank of the relief drain, <br /> outside of the TRM liner. TRM liner installation appears to be warranted along the road ditch <br /> segment, and additional liner installation is warranted along the east bank of the ditch relief <br /> drain. <br /> • Minor rills are present along the lower end of the former access route from Road "G" up to former <br /> Topsoil Pile PP. Hand crew installation of rock checks, straw wattles, or similar measures, along <br /> with broadcast seeding is warranted to facilitate stabilization of the rilled segment. <br /> • There is minor scour along the south road ditch from the vicinity of the gate west of former Topsoil Pile <br /> "SS", up to the vicinity of Culvert PM-15. Minor grading and re-seeding, along with installation of <br /> rock checks or straw wattle checks in series, and/or TRM liner installation appears to be <br /> warranted to stabilize and establish vegetation along the segment. <br /> 3 <br />
