Witt <br />Wright Water Engineers, Inc. <br />2490 West 26th Ave., Suite 100A <br />Denver, CO 80211 <br />Re: Maryland Creek Ranch Substitute Water Supply Plan, DIVIG M96049 <br />Sections 15, 22 and 23, T4S, R78W, 6th P.M. <br />Water Division 5, Water District 36, Summit County <br />Approval Period: August 1, 2009 through July 31, 2010 <br />Dear Mr. Witt: <br />Thank you for your letter of September 7, 2007, requesting a renewal of the substitute <br />water supply plan for the Maryland Creek Ranch aggregate operation in accordance with Section <br />§37-90-137(11), C.R.S. The required fee for the substitute water supply plan was submitted under <br />Receipt No. 512330. <br />Consumptive Use <br />The anticipated net depletions for this plan include evaporation of exposed ground water, <br />water lost in product, water for dust control, truck and vehicle washing, CDOT asphalt production <br />and batch plant operations, domestic use, and water used for approximately 4 acres of landscape <br />irrigation (see Table 2 attached). <br />Net consumptive uses during the next year of mining operations are estimated to total <br />92.0 acre-feet. Table 2 provides a summary of monthly consumptive uses, including calculations <br />of lagged depletions. No phreatophyte credit has been applied to this plan. <br />Replacement Water <br />Replacement water to offset depletions is to be provided by consumptive use credits from <br />the dry-up of 95.5 acres historically irrigated by three ditches within the subject property, and <br />releases from storage from Green Mountain Reservoir and Dillon Reservoir. <br />The three ditches used to provide dry-up credits include the South Rock Creek Ditch, the <br />Old Whetstone/Sheep Creek Ditch and the McKay Ditch. This renewal request indicates that a <br />total of 95.5 acres of hay meadow historically irrigated by these water rights will be dried up and <br />permanently removed from irrigation. Use of these ditches and the approximate irrigated <br />acreages were confirmed by the District 36 Water Commissioner, Scott Hummer, and through a <br />review of an aerial photograph map and diversion records. <br />The renewal included a request to reconsider the historical consumptive use credits <br />available from the dry-up.
