Permit Amendment (AM-06) - Climax Mine <br />¦ Exhibit R provides proof of filing with County Clerks and Recorders; <br />• Exhibit T provides and updated Environmental Protection Plan; <br />¦ The Geotechnical Stability Exhibit presents information regarding geotechnical stability of the <br />Mayflower, McNulty and North 40 facilities; and <br />• The Emergency Response Plan presents emergency procedures and responsibilities of <br />employees in the event of discovering an emergency situation, including designated chemical <br />spills. <br />1.5 Other Project Activities <br />As CIVIC continues to critically evaluate resumption of production at the Climax Mine, opportunities for <br />improvement of previously approved components of the mine will be identified in accordance with the <br />following project goals: <br />¦ Provide for safety of workers and the general public; <br />¦ Protect the environment through continual evaluation and improvement of environmental <br />protection practices; and <br />¦ Employ the best available technological, mineral extraction and environmental protection <br />practices. <br />CIVIC will continue to work closely with state and local officials to provide that these upgrades to Climax <br />facilities and practices are implemented in accordance with applicable regulatory requirements. This <br />process has commenced with submittal and approval of Technical Revisions 14 and 15 in 2008, which <br />authorize improvements to specific components of the mineral processing and water management <br />systems at the mine. <br />The process of identifying opportunities for improvement of previously approved components of the mine, <br />critically evaluating these opportunities, and designing potential improvements requires a significant <br />• investment of time and capital by CIVIC, and an accompanying investment by state and local officials to <br />evaluate the opportunities in relation to regulatory requirements. This process is expected to occur and <br />continue during the coming decades as mining operations continue at the Climax Mine. <br />1.6 Acknowledgements <br />CIVIC would like to acknowledge the numerous Climax Molybdenum personnel who have provided <br />information incorporated into this Permit Amendment, as well as Habitat Management, Inc., W.W. <br />Wheeler and Associates, Inc., Tetra Tech, Inc., and AJAX, Inc. for preparing the amendment and <br />associated exhibits and plans. <br /> <br />Introduction 1-5 May 2010
