Permit Amendment (AM-06) - Climax Mine <br />0 <br />• <br />• <br />identification in the field. <br />The proposed affected land boundary includes a reconfigured delineation of lands in the areas of the <br />Mayflower TSF and McNulty OSF that were initially included within the affected land boundary approved <br />in 1977 and AM-01. These areas were removed from the affected land boundary in AM-02 to facilitate a <br />financial warranty reduction during a period of low molybdenum prices. While not precisely identical, the <br />extent of proposed affected lands associated with these facilities is comparable to that previously <br />approved. Figure AM-06-C-01 (Exhibit C) presents a site map identifying the 1980 (AM-01) affected land <br />boundary, the 1997 boundary, and the current proposed affected land boundary. <br />The proposed affected land boundary also includes an area immediately downstream of the existing <br />Mayflower TSF. This area is included to provide for a contemplated Property Discharge Water Treatment <br />Plant (PDWTP). CMC plans to construct a new water treatment plant at this location to facilitate <br />continued protection of the environment and ongoing compliance with regulatory requirements. <br />Therefore, this area meets the CMLRA §34-32-103(1.5) affected land definition of "the surface of an area <br />within the state that is or will be disturbed by the operation...". The detailed design for this plant has not <br />yet been completed. Climax plans to submit the detailed design information for approval in a future <br />technical revision to the permit. <br />The proposed adjustment to the affected land boundary is an administrative change to the existing permit, <br />which will facilitate implementation of previously approved mineral extraction activities and ongoing <br />protection of the environment. Therefore, it does not represent a significant change in planned mining <br />operations or an expansion of facilities. <br />1.4 Organization of Permit Amendment Application <br />This application is organized in relation to permit amendment application requirements of HRMMR <br />§§1.10(1) and Rule 6.4. As provided by §1.10(1), this application is not required to duplicate information <br />presented in previous submittals, however several exhibits, including the Mining Plan (Exhibit D), the <br />Reclamation Plan (Exhibit E), Baseline updates to Water, Wildlife, Soil, Vegetation and Climate (Exhibits <br />F-K) and the Environmental Protection Plan (Exhibit T) have been updated to incorporate information <br />presented in previous submittals as well as addressing current practices and future plans. The Exhibits <br />submitted with this amendment supersede prior Climax submittals and are intended to present the most <br />current information and plans. Technical Information presented in previous submittals, including technical <br />revisions and previous amendments, and not duplicated herein, is incorporated by reference and remains <br />part of the permit record. <br />New or updated information is included with the following permit amendment exhibits: <br />¦ Exhibit A presents an aliquot part legal description of the proposed affected land, and a map of <br />the affected land boundary in accordance with requirements of HRMMR §6.4.1; <br />¦ Exhibit B presents an updated Index Map; <br />¦ Exhibit C presents a series of updated Pre-Mining and Mining Plan Maps of the Affected Lands; <br />¦ Exhibit D presents an updated Mining Plan consistent with the current conditions and plans for <br />future development; <br />¦ Exhibit E presents the revised reclamation plan consistent with current mine plans; <br />¦ Exhibit F provides reclamation plan maps; <br />¦ Exhibit G provides updated surface and ground water information; <br />• Exhibit H provides updated wildlife information; <br />• Exhibit I provides updated soil mapping and salvage depth information; <br />¦ Exhibit J provides updated vegetation mapping information; <br />¦ Exhibit K provides updated climate information; <br />¦ Exhibit L presents the updated reclamation cost estimate; <br />¦ Exhibit M provides a list of other permits or licenses that Climax holds or is obtaining that are <br />necessary for resumed production at the Climax Mine; <br />¦ Exhibit N presents the source of Climax's legal right to enter areas within the affected land <br />boundary; <br />¦ Exhibit 0 presents proof of mailing of notices to county commissioners and the soil conservation <br />district; <br />Introduction <br />1-4 <br />May 2010
